RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE EXTENSION OF THE SANTA CLARA COUNTY
ABANDONED VEHICLE ABATEMENT SERVICE AUTHORITY (AVASA)
AGREEMENT
WHEREAS, California Vehicle Code Sections 9250.7 and 22710 provide for the
establishment of an abandoned vehicle service authority for the purpose of
removal and disposal of abandoned vehicles; and,
WHEREAS, in 2002, the County of Santa Clara, the cities of Campbell,
Cupertino, Gilroy, Los Altos, Los Altos Hills, Milpitas, Monte Sereno, Morgan Hill,
Mountain View, Palo Alto, San Jose, Santa Clara, Saratoga, Sunnyvale, and the
Town of Los Gatos adopted resolutions in each local jurisdiction extending the
Santa Clara County Abandoned Vehicle Abatement Service Authority (AVASA)
agreement; and,
WHEREAS, funding for AVASA, as authorized under California Vehicle Code
section 9250.7 is scheduled to expire on April 30, 2012, at which time AVASA
would cease to exist; and,
WHERAS, California Vehicle Code section 9250.7 as amended by Senate Bill
106 authorizes the continued collection of the abandoned vehicle abatement fee
over increments of time up to 10 years if the County Board of Supervisors, by a
two-thirds vote, and a majority of the cities having a majority of the incorporated
population within the county adopt resolutions providing for continued collection
of the fee.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell authorizes the continued collection of the abandoned vehicle
abatement fee and participation in AVASA for the period of time beginning April
30, 2012 through April 30, 2022; and,
BE IT FURTHER RESOLVED, that the City Manager of the City of Campbell is
authorized to execute a renewed or amended agreement to continue the City's
participation in AVASA.
