PC Res 2994RESOLUTION NO. 2994 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL FOR A SITE AND ARCHITECTURAL APPROVAL TO ALLOW A NEW SINGLE FAMILY RESIDENTIAL DWELLING ON PROPERTY LOCATED AT 392 WALDO ROAD IN AN R-l-16 (SINGLE FAMILY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF DOLMEN CONSTRUCTION, ON BEHALF OF MR. GERALD BITTNER. FILE NO. S 95-10. After notification and Public Hearing as specified by law on the above- referenced application as per the application filed in the Planning Department and, after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. S 95-10: The proposed dwelling is architecturally compatible with the surrounding area and reflects the policies of the San Tomas Area Neighborhood Plan by incorporating architectural elements including a prominent porch element, framed windows, and a wood shake hip roof. o The subject property is a legal non-conforming lot and can be developed in accordance with the R-l-6 development standards of the San Tomas Area Neighborhood Plan. The proposed project meets the R-l-6 development standards of the San Tomas Area Neighborhood Plan. o The retention of existing mature trees on the site contributes to the quality of the development and enhances the neighborhood. A Condition of Approval requiring a one story porch element will be more in keeping with the existing neighborhood and reflect the policies of the San Tomas Area Neighborhood Plan. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed project is consistent with the intent of the General Plan and the zoning standards. The proposed project will aid in the harmonious development of the immediate area. Planning Commission Resolution No. 2994 S 95-10 -- 392 Waldo Road Page 2 The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Approved Project: Approval is granted for a Site and Architectural Review Permit allowing construction of a new two story single family residence on property located at 392 Waldo Road. Project approval shall substantiallY comply with project plans prepared by Dolmen construction dated August 16 1995, except as modified by the Conditions of Approval herein. Revised Porch Element: The applicant shall submit revised plans modifying the porch elevation to a one story element in accordance with the policies of the San Tomas Area Neighborhood Plan. o Tree Retention/Landscaping: The applicant shall submit a landscaping plan indicating type and size of the five (5) existing trees to be retained as indicated on the approved plans. The plan shall include a tree protection plan and details to protect the trees during construction. The plan shall be submitted to and approved by the Community Development Department prior to issuance of building permits. 3. Park Impact Fee: The applicant shall pay a park impact fee of $10,990 for the new single family residence prior to certificate of building occupancy. Underground Utilities: Cause all electrical, telephone and cable television facilities to be installed underground in accordance with the provisions of Chapter 20.36.150 of the Municipal Code and as required by the City Engineer, prior to occupancy. 5. Water Service: Install a water distribution system in conformance with the requirements of the San Jose Water Company. 6. Driveway Standards: Install asphalt/concrete driveway conforming to S a n Tomas Area Neighborhood Plan for approval by the City Engineer Planning Commission Resolution No. 2994 S 95-10 -- 392 Waldo Road Page 3 o Encroachment Permit: Obtain permits and approvals for work on State of California property (street right-of-way). Permits and approvals must also be coordinated with the City of Campbell. Utility Construction Coordination in Public Right-Of-Way: Submit a Utility Coordination Plan and Schedule for approval by the City Engineer for installation of electrical, telephone, cable television, sewer, water and storm drain improvements to minimize damage to City streets, sidewalks and related facilities prior to issuance of building permits. 9. San Tomas Area Plan: Comply with San Tomas Area Neighborhood Plan design standards for all public improvements. 10. Development Approval Expiration: The Site and Architectural approval for this project is valid for a period of one year from the Planning Commission approval. 11. Sanitary Sewer Service: Install a sanitary sewerage system to serve all lots in conformance with the requirements of the West Valley Sanitation District.
