CC Resolution 11331RESOLUTION NO. 11331 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING THE CAMPBELL VETERANS MEMORIAL PHASE I PROJECT AND ASSOCIATED ACTIONS WHEREAS, on May 1, 2007, the City Council endorsed the concept of a new Campbell Veterans Memorial; and WHEREAS, the location at City Hall between the south wing of the City Hall office building and the Orchard City Green Amphitheater was identified as the preferred site for a future Campbell Veterans Memorial; and WHEREAS, the proposed location for the Memorial was presented to the Parks and Recreation Commission on July 11, 2007, and to the Civic Improvement Commission on July 12, 2007 and both Commissions supported the City Hall location as the preferred site for a new Campbell Veterans Memorial; and WHEREAS, on August 7, 2007, the City Council approved the proposed site for the Veterans Memorial and authorized an advancement of $30,000 to the Veterans Memorial Committee for the design of the Memorial and authorized the Public Works Director to issue a Request for Proposals (RFP) and retain a landscape architect to design the Campbell Veterans Memorial; and authorized the Public Works Director to execute a reimbursement agreement with the Campbell Veterans Memorial Committee for reimbursement of the advanced design fees; and requested that the final design, cost estimate, and construction schedule for the Memorial be presented to the Parks and Recreation Commission and the Civic Improvement Commission for approval prior to presentation to the City Council for final approval; and WHEREAS, on March 12, 2008, the City of Campbell entered into a Consultant Services Agreement with Bill Gould Design for the design of the Campbell Veterans Memorial; and WHEREAS, the refined conceptual design was presented to the Parks and Recreation Commission on November 5, 2008 and to the Civic Improvement Commission on November 13, 2008, and: WHEREAS, on December 8, 2008, City Council approved the design of the Campbell Veterans Memorial; and WHEREAS, the Campbell Veterans Memorial Foundation is not in a financial position to complete the design and construction of the full Veterans Memorial as presented in the approved conceptual design; and WHEREAS, a proposed phased approach to the construction of the Campbell Veterans Memorial has been proposed; and WHEREAS, plans for a Campbell Veterans Memorial Phase I project have been presented for Council's consideration; and WHEREAS, a maintenance agreement providing for the full maintenance of the Phase I improvements by the Campbell Veterans Memorial Foundation will be prepared; and WHEREAS, the current agreement for the design of the Veterans Memorial with Bill Gould Design expired on March 12, 2009 and can be extended by amendment; and WHEREAS, an encroachment permit will be required for the construction of the Campbell Veterans Memorial on public property. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby: 1. Approve the .phasing of the design and construction of the Carr~pbell Veterans Memorial; and 2. Approve the design of the Campbell Veterans Memorial Phase I project; and 3. Authorize the City Engineer to issue a no fee encroachment permit for the construction of the Campbell Veterans Memorial Phase I project; and 4. Authorize the City Engineer to execute an amendment to the Consultant Services Agreement with Bill Gould Design to revise the scope of services and extend the date of the contract to accommodate the phased project approach for the Campbell Veterans Memorial; and 5. Authorize the Civic Improvement Commission to determine an acceptable location for the relocation of the City of Campbell and Tree City USA flags; and 6. Authorize the Public Works Superintendent to prepare and execute an agreement providing for maintenance of the Campbell Veterans Memorial Phase I improvements by the Campbell Veterans Memorial Foundation.
