PC Res 3000RESOLUTION NO. 3000 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A MODIFICATION TO A PREVIOUSLY-APPROVED USE PERMIT (UP 68-15) TO ALLOW THE PLACEMENT OF A PORTABLE CLASSROOM BUILDING ON PROPERTY LOCATED AT 485 W. SUNNYOAKS AVENUE (FIRE STATION) IN A PF (PUBLIC FACILITIES) ZONING DISTRICT. FILE NO. M 95-06 (UP 68-15). After notification and hearing, as per the application filed in the Planning Department; and, after presentation by City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. M 95-06: The proposed classroom building is a permitted use in the P-F (Public Facilities) Zoning District and is consistent with the Public/Semi-Public Use identified on the Land Use Element of the General Plan. o The provided parking adequately addresses the parking demands for this facility. The building placement is so situated that it provides sufficient setbacks to minimize privacy impacts on adjacent uses. o Landscaping is provided along the perimeter of the project and adjacent to proposed building to enhance the appearance of the project site. o The proposed operational hours are consistent with the current operational hours of training of the facility. Based upon the foregoing findings of fact, the Planning Commission concludes that: The establishment, maintenance or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. o The proposed site is adequate in size and shape to accommodate the said use with uses in the surrounding area. Sunnyoaks Avenue Page 2 o The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. 4. The proposed use is compatible with the uses in the area. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Approved Use: Approval is granted for a 2,100 square foot classroom facility on an existing fire station site located at 485 W. Sunnyoaks Avenue. The proposed use shall substantially comply with the applicant's description per the attachments of the Planning Commission report and the following conditions: A. Hours of Instruction: Generally limited to the hours from 8 a.m. to 5 p.m. daily and from 7 p.m. to 9 p.m. for evening classes. B. Class Size: 25 persons Permanent Improvements: Pursuant to the fire service agreement, between the City of Campbell and the Santa Clara County Central Fire District, all improvements and fixtures shall be vested in the City subject to the right of use thereof by the Fire District. At the expiration of service agreement, the classroom building shall be vested in the City. In the event that the classroom building is removed prior to the expiration of the service agreement, all damaged pavement areas shall be refurbished to their original condition. o Landscaping Plan: Landscape plan to indicate upgrading of existing planting areas along the W. Sunnyoaks Avenue frontage and around existing percolation ponds through the introduction of trees. Revised plan to be submitted for approval of the Community Development Director prior to the issuance of building permits. Resolution No. 3000 M 95-06 -- 485 W. Sunnyoaks Avenue Page 3 Santa Clara Valley Water District: Applicant to obtain permit from Santa Clara Valley Water District for the placement of the portable classroom and provide information regarding exercise practices in relation to potential drainage conflicts with the percolation pond facilities. o Right-of-Way: Perform an easement search as needed to verify that the proposed classroom will not adversely impact the rights of the Pacific Gas and Electric Company, San Jose Water Company, West Valley Sanitation District, Santa Clara Valley Water District, Pacific Bell, TCI Cablevision, etc. Sanitary Sewer Service: Contact the West Valley Sanitation District regarding potential requirements. e Water Service: Contact the San Jose Water Company regarding potential requirements.
