RESOLUTION NO. 9549
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
SUMMARILY VACATING EXCESS RIGHT-OF-WAY ALONG THE
INTERSECTION OF CIVIC CENTER DRIVE AND CAMPBELL AVENUE,
AND AUTHORIZING THE PUBLIC WORKS DIRECTOR TO EXECUTE
A LANDSCAPE MAINTENANCE AGREEMENT
WHEREAS, on November 25, 1997 the Planning commission adopted Resolution 3136
approving a Site and Architectural Application and a Conditional Use Permit to allow a mixed
use project of apartments, retail and office space at 125 E. Campbell Avenue (former Bank of
America site); and
WHEREAS, on January 6, 1998 the City Council adopted Resolution 9316 approving
the Planning Commission's recommendations; and
WHEREAS, the applicant was required to submit an application for vacation of excess
street right-of-way; and
WHEREAS, all documents required to vacate the excess right-of-way have been
prepared; and
WHEREAS, in exchange for the City vacating the landscaped site, the property owner
was required to execute a Landscape Maintenance Agreement to maintain the landscaped site;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell
that the City Clerk is authorized to record the Quitclaim Deed to vacate excess right-of-way
and grant property to the adjacent property owner.
BE IT FURTHER RESOLVED that the Public Works Director is hereby authorized to
execute the Landscape Maintenance Agreement on behalf of the City.
