RESOLUTION NO. 9482
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL APPROVING A MODIFICATION (M 98-15) TO A
PREVIOUSLY-APPROVED PLANNED DEVELOPMENT PERMIT
(PD 94-02) TO ALLOW A PROFESSIONAL OFFICE/MEDICAL
OFFICE USE IN ADDITION TO A RETAIL USE FOR THE FRONT
PORTION OF THE BUILDING ON PROPERTY LOCATED AT 535
W. HAMILTON AVENUE IN A PD (PLANNED DEVELOPMENT)
ZONING DISTRICT. APPLICATION OF DR. KENNETH SA V AGE.
FILE NO. M 98-15 (PD 94-02).
After notification and public hearing, as specified by law, and after presentation by the Community
Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council did find as follows with respect to
application M 98-15 (PD 94-02):
1. In addition to the allowed retail use, a medical office use IS a permitted use within the
commercial zoning districts.
2. The proposed office use can be adequately supported by the existing parking.
3. The proposed medical office use or the retail use of the front portion of the building are
compatible with the existing use on the property and surrounding land uses.
4. The proposed modification will permit office uses in the front portion of the building in
addition to retail use of this space.
Based upon the foregoing findings of fact, the City Council further finds and concludes that:
1. The proposed use will aid in the enhancement and the harmonious development of the
immediate area. The establishment, maintenance, or operation of the use will not be
detrimental to the public health, safety, peace, morals, comfort or general welfare of persons
residing or working in the neighborhood of such proposed use.
2. The proposed modification to the use of the development will not be detrimental to the health,
safety or welfare of the neighborhood or the City.
3. The proposed site is adequate in size and shape to accommodate the proposed use and the
surrounding uses in the area.
4. The proposed project is adequately served by streets of sufficient capacity to carry the kind and
quantity of traffic such uses would generate.

The applicant is hereby notified, as part of this application, that he/she is required to meet the following
conditions in accordance with the Ordinances of the City of Campbell and the State of California. The
lead department with which the applicant will work is identified on each condition where necessary.
Additionally, the applicant is hereby notified that he/she is required to comply with all applicable
Codes or Ordinances of the City of Campbell and the State of California that pertain to this
development and are not herein specified:
PLANNING DEPARTMENT
1. Approved Proiect: Approval is granted to allow a medical office use with one doctor in the
1,720 square foot tenant space along the Hamilton A venue frontage located at 535 W. Hamilton
A venue. The minor building changes shall not substantially change the exterior of the approved
building design. Interior and minor exterior changes to accommodate the chiropractic office
shall substantially conform to the plans prepared by Kurt B. Anderson, AIA dated October 4,
1998, except as may be modified by the Conditions of Approval.
2. Compliance with Resolution 8788: The applicant and property owners shall be advised that all
previous conditions of approval provided under City Council Resolution No. 8788 still apply to
the Planned Development Permit (PD 94-02) with the exception that the 1,720 square foot
tenant space shall allow for professional office uses in addition to retail uses.
3. Hours of Operation: The use of the 1,720 square foot tenant space shall be not exceed the
permitted hours of operation as specified below:
Permitted Hours: 6:00 a.m. and 11 :00 p.m. daily.
