RESOLUTION NO. 9387
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
ACCEPTING THE IMPROVEMENTS CONSTRUCTED BY PERMA GREEN
HYDROSEEDING, INC. AND DIRECTING THE FILING OF A
NOTICE OF SUBSTANTIAL COMPLETION AND A NOTICE
OF FINAL COMPLETION
WHEREAS, the City Council adopted Resolution 9256 on August 5, 1997, awarding a
contract to Perma Green Hydroseeding, Inc. for construction of the improvements known as
Morgan Park Improvement Project - Phase I (Project 97-19); and
WHEREAS, Perma Green Hydroseeding, Inc. has substantially completed the
aforementioned contract in accordance with the contract documents; and
WHEREAS, the City has directed the contractor to open the park for public use; and
WHEREAS, the contractor is not yet finished with all remaining punch list work;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell hereby accepts the improvements constructed under the Morgan Park Improvement
Project - Phase I (Project 97-19) and directs the City Engineer to file a Notice of Substantial
Completion.
BE IT FURTHER RESOLVED that at such time as the City Engineer determines all
work on the project is complete, the City Council hereby directs the City Engineer to file a
Notice of Final Completion for the project.
