PC Res 3011RESOLUTION NO. 3011 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL, APPROVING A CONDITIONAL USE PERMIT TO ALLOW RETAIL AUTOMOTIVE SALES ON PROPERTY LOCATED AT 2931 S. WINCHESTER BOULEVARD IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF WAYNE RENSHAW, DAVID TAKAMOTO ASSOCIATES. FILE NO. UP 95-19. After notification and Public Hearing as specified by law to approve a Conditional Use Permit, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 95-19: The proposal is consistent with the General Plan and Zoning designations which indicate a commercial land use for this property. o The proposed site improvements of 10% on site landscaping and streetscape improvements adequately address the aesthetic concerns related to the project/site with the recommended conditions of approval. o Adequate on site parking has been provided for the proposed retail automotive sales and retail/commercial use. 4. The proposed use is compatible with the surrounding adjacent land uses. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes that: The proposed project is consistent with the policies of the General Plan and zoning, and; ° The proposed project will aid in the harmonious development of the immediate area. o The establishment, maintenance or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Approved Project: Approval is granted for a Use Permit allowing for retail automotive sales on property located at 2931 Winchester Boulevard. Project approval shall substantially comply with project plans prepared by Wayne Renshaw dated October 23, 1995, except as modified herein in the Conditions of Approval. e Street Improvements: Remove and replace broken curb and gutter as determined by the City Engineer. Also remove and replace cracked sidewalk squares and remove sidewalk squares for irrigation and tree planting. o Related Street Improvements: Install 2" asphalt concrete overlay to seal utility trench excavation. See "Utility Coordination Construction in Public Right of Way." Street Light Policy: Install one street light in accordance with City of Campbell Street Lighting Policy for arterial streets. Streetscape Improvements: Install street trees, hardscape, and irrigation improvements in the public right-of-way in accordance with the City of Campbell's Streetscape Standards. Landscaping Plans: Applicant shall submit four (4) sets of landscape plans indicating'type and size of plant materials, irrigation system and planting details to be submitted to the Planning department and approved by the Community Development Director prior to issuance of building permits. Landscape plans shall reflect staff recommendations incorporating the following: A. Addition of Evergreen Pear trees on the south property line reflecting the arrangement on the north property line. Bo Addition of two 24" box sized trees, each to be placed within the landscaping areas on the street frontage. Screening of Utility Facilities: Screen all above ground utility equipment within the public right-of-way, on private property or roof mounted to the satisfaction of the Community Development Director. Street Improvement Plans: Provide Street Improvement Plans for review and approval by the City engineer for all improvements and landscaping within the public right-of-way. Grading and Drainage: Provide a preliminary grading and drainage plan for review. A complete grading and drainage plan may be required for approval upon review of the preliminary plan. Storm Drain Design: Design of improvement plans for storm water conveyance facilities shall be based on a 10 year storm frequency. Hydrology and Hydraulic Calculations: Provide hydrology and hydraulic calculations based upon a 10 year storm frequency. Registered Civil Engineer/Land Surveyor: Cause plans, specifications, calculations, reports and designs for street improvements, grading and drainage improvements and Record Map to be prepared and sealed by a Civil engineer, Land Surveyor or Architect, as applicable, licensed in the State of California and submitted to the City Engineer for approval. Standard Specifications and Details: Comply with the City of Campbell Standard Specifications and Details for Public Works Construction. Street and Sidewalks: Comply with Title 11 of the Campbell Municipal Code concerning Streets and Sidewalks. Disability Standards: Comply with the Americans' with Disability Act and the California Disability Access Regulations, whichever applies. Underground Utilities: Install electrical, telephone, and cable television facilities underground, in accordance with the provisions of Chapter 20.36.150 of the Campbell Municipal Code and as required by the City Engineer, prior to occupancy. Utility Construction Coordination in Public Right-of-Way: Submit a Utility Coordination Plan and Schedule for approval by the City Engineer, for installation of electrical, gas, telephone, cable television, sewer, water and storm drain improvements to minimize damage to City streets, sidewalks, and related facilities. Relocate existing water meter to behind back of sidewalk. Sanitary Sewer Service: Provide a sanitary sewerage system to serve all lots in conformance with the requirements of the West Valley Sanitation District. Water Service: Provide a water service in conformance with the requirements of the San Jose Water Company. Other Utility Services: Install electrical and gas service in conformance with the requirements of Pacific Gas and Electric Company. I n s t a 11 telephone facilities in conformance with the requirements of Pacific Bell. Install cable television facilities in conformance with the requirements of TCI Cable. Flood Control: Comply with the Santa Clara Valley Water District's requirements. The grading and drainage plans shall be submitted to the Santa Clara Valley Water District for review and approval. Storm Drain Area Fee: Pay the then current storm drainage area fee prior to issuance of Building Permit. Current amount is $2,500.00 per acre. Security: Provide guarantees to design and construct all public improvements by cash, bonds, letters of credit, or other legal instruments acceptable to the City Attorney, prior to issuance of a building permit. Encroachment Permit: Obtain an Encroachment Permit, pay fees and deposits, provide bonds and insurance certificates for all construction within the public right-of-way. Dust Control: Implement the requirements of the Bay Area Air Quality Control Management District including the following mitigation measures: A. Water all exposed or disturbed soil surfaces to control dust, as necessary, but not less than twice daily; B. Water areas of digging and grading operations; C. Suspend grading or other dust producing activities during periods of high wind; D Water or cover stock piles of soil debris, sand and other dust producing materials; E. Sweep construction area and surrounding streets daily. F. Cover trucks with tarp during hauling. Completion Prior to Occupancy: Complete construction of all required off-site and on-site improvements prior to occupancy of any structure. Building Occupancy: Obtain any necessary building permits to change with occupancy to B-2 to B-1 through the City of Campbell's Building Department. Also include ventilation and occupancy separations for such use. Vehicle Storage: The storage of all vehicles for the use of sales or display shall be contained within the building or on the back portion of the property. Use: The use shall be restricted to the resale and refinancing of automobiles. There shall be no maintenance or restoration of vehicles on the property. The additional use for the property which may be added at a later time shall be restricted to those uses permitted within the C-2 zoning district. Hours of Operation: Hours of operation shall be limited 6 a.m. To 11 p.m. in accordance with other uses permitted in the C-2 zoning district.
