RESOLUTION NO. 9293
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
REJECTING ALL BIDS FOR CONSTRUCTION OF THE
HAMILTON/EDEN A VENUE TRAFFIC SIGNAL PROJECT 96-22 AND
AUTHORIZING THE READVERTISEMENT OF THE PROJECT
WHEREAS, plans and specifications for the construction of the Hamilton/Eden Project
(96-22) were approved by City Council on August 5, 1997 and bids were solicited and opened
on October 7, 1997; and
WHEREAS, the low bidder was Mike Brown Electric Company in an amount of
$213,891.50; and
WHEREAS, the low bidder requested withdrawal of the proposal and bid security on
October 10, 1997; and
WHEREAS, staff has reviewed the request and has determined that under the
circumstances presented and in accordance with City Specifications the bidder may be relieved
of their bid without forfeiture of the bid security; and
WHEREAS, staff has reviewed the low bid and determined it was unresponsive due to
the listing of subcontractors in excess of 50 % of the total amount of contract work; and
WHEREAS, the remaining bids were substantially higher than the Engineer's Estimate
for the work to be completed and were therefore determined to be unresponsive; and
WHEREAS, the HES grant funding for the project is committed and readvertisement of
the project is possible without jeopardizing the HES funding for the project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell
that all bids for the construction of the Hamilton/Eden Avenue Project (96-22) received on
October 7, 1997 are hereby rejected and the project shall be readvertised within six months
when directed by the Public Works Director.
