RESOLUTION NO. 9283
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL GRANTING APPROVAL OF A REINSTATEMENT (R
97-01) OF A PREVIOUSLY-APPROVED PLANNED
DEVELOPMENT PERMIT (PD 90-06) TO ALLOW THE
CONSTRUCTION OF A FIVE-UNIT TOWNHOME PROJECT ON
PROPERTY LOCATED AT 80 DOT AVENUE IN A PD (PLANNED
DEVELOPMENT) ZONING DISTRICT . APPLICATION OF MR. TED
BORNS. FILE NO. R 97-01 (PD 90-06).
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council did find as follows with
respect to application R 97-01 (PD 90-06).
1. There have been no changes in the General Plan and Zoning in the area since the original
approval.
2. There have been no changes in the development standards or regulations which would
warrant change to the conditions of approval.
Based on the foregoing findings of fact, the City Council further finds and concludes that:
1. The proposed development and uses clearly result in a more desirable environment and use
of land than would be possible under any other zoning classification.
2. The development and uses will be compatible with the General Plan of the city and will aid
in the harmonious development of the immediate area.
3. The proposed development would not be detrimental to the health, safety or welfare of the
neighborhood or the City as a whole.
4. That a reinstatement of the Planned Development Permit for this project for a period of one
year from City Council approval is consistent with previous extensions of approval granted
by the City Council.
The applicant is hereby notified, as part of this application, that he/she is required to meet the
following conditions is in accordance with the ordinance of the City of Campbell and the State of
California. Additionally, the applicant is hereby notified that he/she is required to comply with
all applicable Codes or Ordinances of the City of Campbell and the State of California that
pertain to this development and are not herein specified:

APPROVED PROJECT
1. Approved Proiect: This approval is for the extension of previous Planned Development
Permit for five townhomes on the subject property. Development shall substantially
comply as shown on the drawings listed below, exception as modified by conditions
contained herein.
A. Project drawings for Borns Construction prepared by G & G Design consisting of six
sheets dated August 1990.
2. Previous Conditions: All previous conditions of approval shall remain in effect as
stipulated in City Council Resolution No. 8789, except that Condition No. 17 shall be
modified to read and conditions 23 & 24 are added to clarify fire access roadway
requirements.
A. Planned Development Permit approval shall expire one year from the date of City
Council reinstatement, unless building permits have been issued.
23. Fire Apparatus (Engine) Access Roads Required: Provide access roadways with a
paved all weather surface and a minimum unobstructed width of 20 feet, vertical clearance
of 13 feet 6 inches, minimum circulating turning radius of 36 feet outside and 23 feet
inside, and a maximum slope of 15%. Installations shall conform with Fire Department
Standard Details and Specifications A-I.
24. Fire Lane Markings Required: Provide marking for all roadways within the project.
Markings shall be per fire department specifications. Installations shall also conform to
Local Government Standards and Fire Department Standard Details and Specifications A-6
