RESOLUTION NO. 9270
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AWARDING THE CONTRACT FOR THE DESIGN AND CONSTRUCTION
OF THE FUEL TANK PROJECT (97-10) TO BALCH PETROLEUM, AUTHORIZING
THE PUBLIC WORKS DIRECTOR TO EXECUTE A CONTRACT AND
APPROVING A BUDGET ADJUSTMENT
WHEREAS, a proposal was received to complete the design and construction of the
Fuel Tank Modification Project; and
WHEREAS, Balch Petroleum has presented a favorable cost for the project and has
been found to be highly qualified and capable of completing the work; and
WHEREAS, allocating a construction contingency of 25 % is recommended due to the
potential for soil remediation work; and
WHEREAS, Balch will be paid on a delayed payment schedule with two-party checks
to subcontractors and Balch will provide the City with a one year service contract after
completion of the project; and
WHEREAS, a budget adjustment has been prepared to reappropriate $68,939 from the
unappropriated Motor Pool fund balance to the project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell
that the contract for the Design and Construction of the Fuel Tank Modification Project (97-
10) be awarded to Balch Petroleum and the requirement for a performance bond, labor and
materials bond and maintenance bond be waived.
BE IT FURTHER RESOLVED that the Public Works Director is hereby authorized to
execute a contract with Balch Petroleum in the amount of $158,631 and encumber a 25%
contingency in the amount of $39,658 for a total amount of $198,289 and execute change
orders in any amount not to exceed the 25 % contingency.
BE IT FURTHER RESOLVED that the attached budget adjustment is hereby approved.
