PC Res 3012RESOLUTION NO. 3012 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL, RECOMMENDING THE REINSTATEMENT (R 95-02) OF A PREVIOUSLY-APPROVED CONDITIONAL USE PERMIT (UP 94-01) ALLOWING THE ESTABLISHMENT OF A FITNESS CLUB ON PROPERTY LOCATED AT 700 W. HAMILTON AVENUE IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF MR. JERRY McCALL, GOLD'S GYM. FILE NO. R 95-02 (UP 94-01). After notification and Public Hearing, as specified by law, on the application for the reinstatement of a previously-approved Planned Development Permit and after presentation by the Community Development Director, proponents and opponents, the hearing was dosed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. R 95-02 (UP 94-01): No substantial evidence has been presented which shows that the project, subject to the Conditions of Approval, would have a significant adverse impact on the environment. A previous initial study was conducted by the City of Campbell in order to evaluate the potential for adverse impacts, either individually or cumulatively. Review of this project indicates that this proposal and present environmental conditions are similar to those studied previously. According to the traffic study, this type and size of use (a 28,000 square foot exerdse and fitness facility), will generate 119 additional vehicle trips during the evening peak traffic hour. The increased number of vehicles from the use exiting the site from the Hamilton Avenue driveway, crossing three traffic lanes to enter the left turn lane to northbound San Tomas Expressway, will impact the safety of this section of Hamilton Avenue. Additionally, this situation will increase use of the Gayle Drive driveway in order to enter safely onto Hamilton Avenue at a controlled intersection, resulting in a significant increase of vehicle traffic from this use on neighboring residential streets. To provide for safe exiting from the Hamilton Avenue driveway for northbound traffic from this use, and to avoid the impacts of increased vehicle traffic from this use on neighboring residential streets, breaks in the traffic along Hamilton Avenue are necessary. Hamilton Avenue - Gold's Gym Adopted on December 12, 1995 Page 2 o 10. can be provided by a signal interconnect between the Darryl/Hamilton signal and the San Tomas Expressway/Hamilton signal. The $9,000 fee required as a Condition of Approval will be utilized as Gold's Gyms portion of the cost of the signal interconnect to provide traffic breaks on the project's section of Hamilton Avenue. There is therefore a reasonable relationship between the signal interconnect fee and the impacts of the proposed use. There is no evidence before the City of Campbell indicating that the proposed project will have any potential for an adverse affect on wildlife resources. The proposed exercise facility is consistent with the commercial land use designation shown on the Land Use Element of the General Plan. The proposed exercise facility, subject to the conditions imposed, addresses the development standards of the General Commercial Zoning District. Adequate parking and drculation improvements have been provided to integrate the proposed use into the neighborhood. 11. The proposed parking adequately addresses the parking needs of the existing office use and proposed exerdse fadlity based upon varied hours and parking demands as well as the concept of shared parking. 12. The proposed use will compliment the existing office use and is compatible to surrounding and adjacent uses. Based upon the foregoing findings of fact, the Planning Commission further finds and concludes, subject to the Conditions of Approval, that: The Conditions of Approval are roughly proportional and reasonably related in nature and extent to the impacts of the project. Hamilton Avenue - Gold's Gym Adopted on December 12, 1995 Page 3 The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use. The proposed use will not be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the said use. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. The proposed use is compatible with the uses in the area. The applicant is hereby notified, as part of this application, that he is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with which at the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. APPROVED USE Approval is granted for an exerdse club of approximately 28,000 square feet located at 700 W. Hamilton Avenue. The proposed business shall substantially comply with the applicant's description per attachment #3 of the Planning Commission report and the following conditions: Operational Hours: Monday through Friday Saturdays & Sundays 5 a.m. to midnight 6 a.m. to 9 p.m. Development Approval Expiration: The Use Permit approval R 95-02 (UP 9-01) for this project is valid for a period of one year from the Planning Commission approval. All conditions of approval specified herein must be completed within one year from the date of approval or the Use permit shall be void. Resolution No. 3012 R 95-02 (UP 94-01) -- 700 W. Hamilton Avenue -- Gold's Gym Adopted on December 12, 1995 Page 4 Revocation of Use Permit: Failure to comply with the conditions of approval specified herein may result in initiation of revocation of the Use Permit by the City in accordance with Section 21.72.110. SITE /STREET IMPROVEMENTS Parking and Driveways: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal Code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. Parking area to be restriped with designation of spaces as well as traffic flow markings. (Planning) Grading and Drainage Plan: Prior to issuance of any building permits for the site, the applicant shall prepare grading and drainage plans, and conduct hydrology studies as necessary to determine the adequacy of the drainage of the site with the proposed changes, and submit these to the City Engineer for review. All storm runoff shall be collected on-site and conveyed underground to the City's existing public storm drain system. Plans shall show the overland release points during flooding. (Public Works) Landscape Plan: Applicant to submit four copies of landscape and irrigation plans to the Planning Department for approval of the Community Development Director prior to issuance of building permits. Revised landscaping plans to address the following items: Provision of boulevard treatment consistent with the Streetscape Standards. The plan shall indicate the sidewalk transition to the neighboring property, with the transition occurring on applicant's property. Grass areas on either side of the new sidewalk shall be of sod for 10' on either side. The area for right-of-way dedication shall be indicated and dimensioned. Replacement of landscaping which has died, and refurbishment of the irrigation system, to include: the provision of canopy type trees (minimum 15-gallon size), shrubs and ground cover throughout the parking area, redwood tree screening along the expressway, tree screening adjacent the residential boundary of a tall variety, trees and ground cover along the western building elevation, trees, shrubs and ground cover along Gale Drive, screening of utility boxes and trash containers. Existing trees to be retained shall be protected consistent with the Water Effident Landscape Standards (WELS) adopted by the City of Campbell. De A bicycle rack shall be provided near the entry door, and shall be indicated on the landscape/parking plan. Property Maintenance: Applicant is responsible to maintain fencing and landscaping in accordance with the approved plans. (Planning Department) Performance Bond: Applicant is to either: A. Post a faithful performance bond in the amount of $25,000 to ensure landscaping, fencing and striping of parking areas within three months of completion of construction; or B. File a written agreement to complete landscaping, fencing and striping of parking area. Bond or agreement to be filed with the Planning Department prior to application for a building permit. (Planning) Dedication to the City: Prior to issuance of any building permits for the site, the applicant shall dedicate additional right-of-way along Hamilton Avenue frontage to accommodate the required installation of the City Streetscape Standards. Applicant shall prepare all documents necessary to record dedication and submit to the City for review, acceptance, and recording. The final site plan shall indude the following: a) The transition of new City Street Standards to existing street improvements along Hamilton Avenue. b) The area of dedication to the City. (Public Works) Public Street Improvements: Prior to issuance of any building permits for the site, the applicant shall prepare plans, pay fees, post securities and provide insurance as required to obtain an encroachment permit to construct public street improvements as required by the City Engineer. Public street improvement plans shall be prepared by a registered Civil Engineer licensed in the State of California, and shall include the following on the Hamilton Avenue frontage: Resolution No. 3012 R 95-02 (UP 94-01) -- 700 W. Hamilton Avenue -- Gold's Gym Adopted on December 12, 1995 Page 6 Removal of existing improvements and construction of City Standard Streetscape improvements, including 10' landscape strip, 7' sidewalk, transition to existing improvements, street trees, irrigation, and installation of two new street lights. Existing fire hydrant must be relocated if it encroaches into the new sidewalk location. (Public Works) 11. Completion of Public Street Improvements: Prior to issuance of occupancy permit for the site, all public improvements as required by the encroachment permit must be completed and accepted by the City Engineer. The applicant must provide the required bond for Faithful Performance of the Maintenance Period. (Public Works) 12. Traffic Mitigation: Prior to issuance of a final occupancy permit for the site, applica~t shall pay a sum of $9,000 (nine thousand dollars) to fund the applicant's share of the signal interconnect between the intersections of Darryl/Hamilton and San Tomas Expressway/ Hamilton. (Public Works) PROPERTY MAINTENANCE/UTILITIES 13. Property Maintenance: The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut or be demolished or removed from the property. Section 11.201 & 11.414, 1985 Ed. Uniform Fire (Fire/Planning) 14. Trash Containers: Trash container(s) of a size and quality necessary to serve the development shall be located in area(s) approved by the Fire Department and the Community Development Director. Unless otherwise noted, endosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-dosing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. (Fire Department/Planning) 15. Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, and rubbish produced within the City limits shall be made with Green Valley Disposal Company. Underground Utilities: Install new on-site utilities underground per Section 20.36.150 of the Campbell Municipal; Code for any new or remodeled building additions. Provide evidence from all utility companies that the proposed modifications can be served. Comply with the plan submittal, permit and fee requirements of the utilities associated with new or modified service connections. (Public Works) PUBLIC SAFETY/WELFARE 17. Handicapped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped. (Building) 18. Equipment Screening: All mechanical equipment on roofs and all utility meters to be screened as approved by the Planning Director. (Planning) 19. Lighting Plan: A lighting plan shall be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit if modifications to existing exterior lighting are proposed. (Planning) 20. Signs: A sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. No sign shall be installed until application is approved and a permit issued by the Planning and Building Departments (Section 21.53 of the Campbell Municipal Code). Project signing as presented on plans is not approved. All temporary signs shall conform to the Temporary Sign Ordinance. (Planning) FIRE DEPARTMENT 21. Construction Drawings: Submit scaled and dimensioned construction drawings to the Building Department for review and permit. All construction shall comply with the 1991 California Building Code for Type II-One Hour. 22. Exits: Exits shall comply with the California Building Code, Chapters 8 and 33. 3. One-Hour Separation/Child Care Use: Provide a one-hour rated occupancy separation which is both vertical and horizontal between the Child Care use and the balance of the tenant space. Fire Alarm System: Provide/maintain a fire alarm system for monitoring fire sprinkler system by an approved Central Station. 25. Access Keys in Lock Box: Tenant to provide access keys for storage in the building access key lock box (Knox). BUILDING DEPARTMENT 26. Stairway Fire Rating: Stairway construction shall be of a minimum 1 hour fire-rated construction, including doors, per UBC 3308(b). 27. Corridor Fire Rating: The corridor on the second floor shall be of a minimum 1 hour fire-rated construction, with doorways and other openings of a minimum 20 minute construction. 28.
