RESOLUTION NO. 9231
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING CONTRACTING FOR REMOVAL AND REPLACEMENT
OF UNDERGROUND STORAGE TANKS ON THE BASIS OF QUALIFICATIONS
WHEREAS, the City Council finds:
1. The City has one (1) underground waste oil storage tank and two (2)
underground fuel tanks in need of removal and replacement and one (1) fuel tank in need
of removal only.
2. The removal and replacement of the tanks will reqUire extremely
specialized services in order to prevent soil contamination.
3. Specialized engineering will be required in connection with the removal and
replacement of the tanks to comply with all the local, state and federal permit requirements
and provide a competent design to avoid unnecessary hazardous material spills.
4. An experienced firm with the foregoing skills and a proven track record is
necessary to successfully carry out this project;
5. A competitive bid process on this project could result in a less experienced
firm performing all or part of the contract, causing costly environmental damage.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell hereby finds that the contract for removal and replacement of the
aforementioned underground storage tanks calls for specially trained and experienced
persons for special services in engineering matters, and that the nature of the work is such
that competitive bidding would be unavailing or would not produce an advantage; and
advertising for competitive bids would thus be undesirable, impractical or impossible and
thus would not serve the best interests of the public.
BE IT FURTHER RESOLVED that staff is authorized to issue a Request for
Proposal for the design and construction of underground fuel tank modifications and the
applicant selection shall be based on the quality of the summary, qualifications of the firm,
personnel assigned to the project, delivery schedule, references and cost.
