RESOLUTION NO. 9226
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
ADOPTING THE FIRST AMENDMENT TO THE COUNTY OF SANTA CLARA
COUNTYWIDE NONDISPOSAL FACILITY ELEMENT
AS THE CITY OF CAMPBELL'S NONDISPOSAL FACILITY ELEMENT
PURSUANT TO PUBLIC RESOURCES CODE SECTION 41730 ET SEQ
WHEREAS, California Public Resources Code Section 41730 et seq. requires the City
of Campbell (City) to prepare, adopt and transmit to the County of Santa Clara (County) a
Nondisposal Facility Element that identifies all existing, expansion of existing, and proposed
nondisposal facilities which will be needed to implement the City's source reduction and
recycling element; and
WHEREAS, the County of Santa Clara First Amendment to the Countywide
Nondisposal Facility Element (NDFE) has been prepared by County staff in accordance with
requirements of Public Resources Code Section 41730 et seq., and said NDFE identifies all
existing, expansion of existing, and proposed nondisposal facilities necessary to implement the
Source Reduction and Recycling Element of the City; and
WHEREAS, pursuant to Public Resources Code Section 41734 the NDFE has been
reviewed by the Solid Waste Commission of Santa Clara County, acting as the Local Task
Force; and
WHEREAS, pursuant to Public Resources Code Section 41735, the adoption of the
NDFE is not subject to the environmental review requirements of the California Environmental
Quality Act; and
WHEREAS, pursuant to Section 18766 of Title 14, Chapter 9, Article 7.0, of the
California Code of Regulations, the City has conducted a public hearing on the final draft of
the NDFE, and after testimony was presented, and upon a review of all evidence in the record;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell
that the County of Santa Clara First Amendment to the Countywide Nondisposal Facility
Element is hereby approved and adopted.
BE IT FURTHER RESOLVED that the City Council of the City of Campbell hereby
authorizes the County of Santa Clara to submit a copy of this resolution and the NDFE to the
California Integrated Waste Management Board on the City's behalf.

of Campbell, County of Santa Clara, State of California, by the following roll call vote:
