PC Res 3013RESOLUTION NO. 3013 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL APPROVING A SITE AND ARCHITECTURAL APPLICATION TO ALLOW THE CONSTRUCTION OF A RETAIL BUILDING (6,250 SQUARE FEET) AND THE DEMOLITION OF A 10,000 SQUARE FOOT RESTAURANT ON PROPERTY LOCATED AT 1700 W. CAMPBELL AVENUE. APPLICATION OF BANDUCCI ASSOCIATES ARCHITECTS, ON BEHALF OF KIRKWOOD PLAZA. FILE NO. S 95--15. After notification and Public Hearing as specified by law on the above- referenced application as per the application filed in the Planning Department and, after presentation by the Community Development Director, proponents and opponents, the hearing was dosed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. S 95-15: The applicant's proposal to construct a new retail building replacing an existing restaurant is consistent with the General Plan and the C-1-S Zoning District which permit commercial land uses. e The project site is adequately improved and sized to accommodate the proposed building. The proposal complies with the development standards of the C-1-S Zoning District in relationship building heights, landscaping and setbacks. The proposal will not significantly disturb the peace and enjoyment of nearby residential neighborhoods. The proposed parking will adequately address the parking demand for the existing and proposed commercial uses. Based upon the foregoing findings of fact, the Planning Commission concludes that: The proposed project, subject to the conditions imposed, will be consistent with the General Plan; and e The proposed project, subject to the required conditions, will aid in the harmonious development of the immediate area. Campbell Avenue Page 2 Approval is effective ten days after decision of approval of the Planning Commission, unless an appeal is filed, subject to the following Conditions of Approval: APPROVED USE 1. Approved Use: This approval is for a 6,234 sq. ft. retail building located at 1700 W. Campbell Ave. Project approval shall substantially comply with plan submittal dated 11/14/95 prepared by David Banducci Assoc. Consisting of 5 sheets. (Community Developmen0 2. Hours of Operation: following: Hours of operation are to be limited to the 1. Retail Uses Permitted in C-1-S (Neighborhood Commercial) 6 a.m. to 11 p.m. (Daily) Zoning District (Community Developmen0 o Signs: Applicant shall apply for and comply with all required signs per the City's requirements.(Community Development) o Landscape Plan: Applicant to submit a landscape and irrigation plan for approval of the Community Development Director addressing the following: Provide details of enlarged sidewalk area in terms of plant containers, lighting, bollards and pavement treatment and other pedestrian amenities. Landscape and irrigation plan to be submitted and approved prior to the issuance of building permit. 5) Trash Enclosures: Appropriate trash enclosure facilities to be provided to service new retail uses. Any new facilities to be approved by the Community Development Director and Central Fire District.(Community Development) 6) Sprinklers: The required fire flow for the finished building is 2,850 GPM at 20 psi residual pressure.
