RESOLUTION NO. 9161
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE PUBLIC WORKS DIRECTOR TO EXECUTE AGREEMENT
WITH SANTA CLARA COUNTY FOR FUNDING, CONSTRUCTION AND
MAINTENANCE OF A NEW PEDESTRIAN BRIDGE CONNECTING LOS
GA TOS CREEK WITH THE MOZART PEDESTRIAN OVERCROSSING;
AUTHORIZING THE RE-BIDDING OF THE PROJECT; AND
APPROVING A BUDGET ADJUSTMENT
WHEREAS, the City of Campbell has accepted administrative responsibility for the
design and construction of the connection between the Mozart Pedestrian Overcrossing (POC)
and the Los Gatos Creek Trail; and
WHEREAS, Santa Clara County has agreed to accept maintenance responsibilities for
the completed project; and
WHEREAS, the City of Campbell has previously rejected bids for the project as being
significantly higher than available funding; and
WHEREAS, the City of Campbell has obtained the necessary additional adequate funding
to re-bid the project by agreeing to relinquish guaranteed funds in the amount of approximately
$22,000 from 1997/1998 Transportation Development Act (TDA) sources and to accept funding
of $59,000 from the State Clean Air Funds administered by the County Transportation Agency
and $50,000 from County unobligated capital funds.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell
that the Public Works Director is hereby authorized to execute the attached maintenance and
funding agreement with Santa Clara County.
BE IT FURTHER RESOLVED by the City Council of the City of Campbell that the
attached budget adjustment is hereby approved, and authorization is hereby granted to re-bid the
project for a pedestrian bridge connecting Los Gatos Creek Trail to the Mozart POC.

Based on the second issue bid results for this project, additional funding will
be required to complete the construction of the Mozart Bridge. $59,000 has been
procured from the santa Clara valley Transit Authority and $50,000 from the
County of Santa Clara.. .
