CODE 27361.6 RESOLUTION NO. 9139 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL SUMMARILY VACATING EXCESS STREET RIGHT-OF-WAY AT 1260 BURROWS ROAD WHEREAS, pursuant to the San Tomas Area Neighborhood Plan adopted by the City Council on December 16, 1993, and pursuant to the Council's approval of the Parcel Map recorded October 28, 1992, filed in Book 641 of Maps, at Pages 36 and 37, excess right-of-way for street purposes exists along the west side of the property known as 1260 Burrows Road; and WHEREAS, the property owner adjacent to this subject excess street right-of-way has requested that the City vacate the excess street right-of-way to him; and WHEREAS, this vacation is made pursuant to Chapter 4, Summary Vacation, of Part 3 of Division 9 of the California Streets and Highway Code; and WHEREAS, the property to be vacated is described on the attached legal description "Exhibit A" and on the attached Plat "Exhibit B" reserving a public use/public utility easement for the benefit of the City of Campbell and the utility companies over, under and upon said property; and WHEREAS, the property to be vacated constitutes excess street right-of-way not required for street or highway purposes; and WHEREAS, from and after the date that this resolution is recorded, the street portion or portion thereof vacated no longer constitutes a public street; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell does hereby vacate the excess right-of-way at 1260 Burrows Road, authorizes the Public Works Director to execute the Quitclaim Deed and/or the required legal documents for vacation of this property, and authorizes the City Clerk to record this Resolution and Quitclaim Deed and/or the required legal documents with the County Recorder's Office.
