WINCHESTER BOULEVARD IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT.. APPLICATION OF P-COM. M 96-09. After notification and public hearing, as specified by law, and after presentation by the Community Development Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows with respect to application M 96-09: 1. The proposed project is located in a commercial General Plan land use area and a Planned Development (PD) zoning district for which approval was granted as a research and development building. 2. The proposed liquid nitrogen tank is industrial in nature. 3. The proposed project will intensify the use of the site and increase the impact on the adjoining residential area. The City Council further finds and concludes that the evidence does not demonstrate: 1. The proposed project is consistent and compatible with the General Plan and the City's zoning ordinance; 2. The proposed project as conditioned will not change the existing use of the site and will, therefore, be compatible and harmonious with existing uses in the surrounding area. 3. The proposed project will result in a more desirable environment and use ofland. 4. The establishment, maintenance or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City..
