RESOLUTION NO. 9113
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE PUBLIC WORKS DIRECTOR TO EXECUTE
AN AGREEMENT WITH PACIFIC BELL REGARDING
ADV ANCED COMMUNICATIONS NETWORK TEST
WHEREAS, on February 8, 1996, the Telecommunications Act of 1996 was signed into
law allowing telephone companies to enter the video programming and delivery marketplace; and
WHEREAS, Pacific Bell is currently installing and testing an Advanced Communications
Network (ACN) in portions of San Jose and unincorporated Santa Clara County on Campbell's
eastern border; and
WHEREAS, Pacific Bell inadvertently included approximately 40 Campbell residents in
their ACN test; and
WHEREAS, Pacific Bell proposed compensation at the rate of $3 per month per
participating resident as an offset to any potential loss of cable franchise fees through a migration
away from TCI; and
WHEREAS, staff has negotiated a settlement agreement with Pacific Bell to provide a
one-time payment of $840 as compensation for the inadvertent connection of Campbell residents.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
hereby authorizes the Public Works Director to execute the attached Settlement Agreement.
