RESOLUTION NO. 8999
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
REJECTING ALL BIDS FOR THE CAMPBELL INN BRIDGE (01-07);
CAMPBELL PARK BRIDGE (93-51); AND MOZART BRIDGE (95-10),
AUTHORIZING READVERTISING FOR BIDS WITH A REVISED BID PACKAGE;
ADOPTING THE ATTACHED FINDINGS AND AUTHORIZING
THE ISSUANCE OF A REQUEST FOR PROPOSALS FOR THE CAMPBELL
PARK BRIDGE AND
AUTHORIZING THE PUBLIC WORKS DIRECTOR TO ENTER INTO A
PURCHASE AGREEMENT FOR FABRICATION OF THE
CAMPBELL PARK BRIDGE
WHEREAS, bids were received for the construction of the Campbell Inn Bridge,
Campbell Park Bridge, and Mozart Bridge on June 7, 1996; and
WHEREAS, all bids were found to not accurately reflect the actual cost of the work
proposed; and
WHEREAS, the City and the Traffic Authority have entered into an agreement for
construction of the Mozart Bridge, however, the Mozart Bridge may not be adequately funded
to allow construction of the project concurrently with the Campbell Inn and Campbell Park
Bridges; and
WHEREAS, staff has revised the project plans and specifications to include the Mozart
Bridge as an additive alternate; and
WHEREAS, the Engineer's Estimates for the projects have been revised to reflect the
current anticipated project costs and the bidding of Mozart Bridge as an additive alternate; and
WHEREAS, Section 3.20.091 of the Campbell Municipal Code allows the Council to
approve the issuance of a Request for Proposals (RFP) when the formal bidding procedures are
not practical or advantageous; and
WHEREAS, the attached findings support the issuance of an RFP for fabrication and
delivery of the Campbell Park Bridge; and
WHEREAS, TDA funds allocated for the Campbell Park portion of the project must be
encumbered by June 30, 1996 in order to ensure reimbursement of expenses; and
WHEREAS, the execution of a purchase agreement with a bridge fabricator prior to
June 30, 1996 would serve to accelerate the construction schedule of the Campbell Park Bridge
and would secure the allocated TDA funding for the project; and
WHEREAS, staff can order this bridge directly from a bridge manufacturer and arrange
for a contractor to set it in place and realize cost savings.
NOW, THEREFORE, BE IT RESOLVED, that the bids received for the Campbell Inn
Bridge (01-07); Campbell Park Bridge (93-51); and Mozart Bridge (95-10) are hereby rejected
and staff is authorized to call for bids with a revised bid package.
BE IT FURTHER RESOLVED that the Public Works Director is authorized to accept
proposals for the Campbell Park Bridge and to enter into a Purchase Agreement for said bridge
in an amount not to exceed $120,000.

Findings for the issuance for the Request For Proposals for the Fabrication and Delivery
of the Campbell Park Bridge:
In accordance with Section 3.20.091 Request for Proposals of the Municipal Code, the City
Council does find as follows:
The procurement of the Campbell Avenue Bridge can most appropriately be accomplished by
the issuance of a Request for Proposals as opposed to formal bidding procedures due to:
- the technical nature of the required bridge structure;
- the overriding need for a quality product;
- the ability of the selected firm to deliver the product within a specific time frame as
directed by the City; and
- the selected firm's reliability and capability to provide and coordinate shop drawings
with the City's selected contractor.
