RESOLUTION NO. 8923
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF CAMPBELL SUMMARIL Y VACATING EXCESS STREET
RIGHT-OF-WAY ON SAN TOMAS AQUINO ROAD AND ELAM AVENUE
WHEREAS, pursuant to the San Tomas Area Neighborhood Plan adopted by the City
Council on December 16, 1993, and pursuant to the Council's approval of the Tentative Parcel
Map for Tract 8748 on June 20, 1995, excess right-of-way exists along the west side of San
Tomas Aquino Road from Elam Avenue to approximately 260 feet north of Elam Avenue and
along the north side of E1am Avenue from San Tomas Aquino Road to approximately 450 feet
west of San Tomas Aquino Road; and
WHEREAS, the property owner adjacent to this subject excess right-of-way, Cobblestone
Limited Partnership, a California Limited Partnership, has requested that the City vacate the right-
of-way and grant it to them; and
WHEREAS, this vacation is made pursuant to Chapter 4, Summary Vacation, of Part 3
of Division 9 of the California Streets and Highway Code; and
WHEREAS, the properties to be vacated are shown on the Final Map; and
WHEREAS, the properties to be vacated constitute excess right-of-way not required for
street or highway purposes; and
WHEREAS, the street portion or portion thereof is no longer required to be a public
street.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell
does hereby vacate the excess right-of-way along San Tomas Aquino Road and E1am Avenue,
authorizes the Public Works Director to execute the Quitclaim Deed and/or the required legal
documents for vacation of this property, and authorizes the City Clerk to record this resolution
and Quitclaim Deed and/or the required legal documents with the County Recorder's Office.
