RESOLUTION NO. 8915
WHEREAS, on June 6, 1995, the City of Campbell entered into a Park Development
Agreement with New Cities Development Construction Inc. (NCD) for development of a
new park at the site of the former San Tomas School; and
WHEREAS, on August 1, 1995, council approved a conceptual plan for the design
of park improvements; and
WHEREAS, final plans and specifications have been produced in accordance with
the approved conceptual plan; and
WHEREAS, NCD, as the developer of Tract 8726, is required to contribute $395,640
in Park Development Fees, or construct a like amount of improvements on the park site;
and
WHEREAS, staff has negotiated a division of the construction work with New Cities
Development which will result in a construction project equal to NCD's fee obligation, and
another project which will be constructed separately by the City; and
WHEREAS, the City's portion of the construction work must be let for public bid.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Campbell that the scope of construction of park improvements, detailed in the attached
council report, is hereby approved, and that the plans and specifications for the San Tomas
Area Neighborhood Park project are hereby approved, and that the Public Works Director
is hereby authorized to issue such plans and specifications for public bid.
