CC Resolution 8881 RESOLUTION NO. 8881 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL ESTABLISHING UNDERGROUND UTILITY DISTRICT NO.7 ON POLLARD ROAD BETWEEN YORK AVENUE AND 200' EAST OF MARSAN COURT WHEREAS, a Public Hearing was called on September 19, 1995, at the hour of 7:30 p.m. in the Council Chambers of City Hall to ascertain whether the public necessity, health, safety or welfare required the removal of poles, overhead wires and associated overhead structures and the underground installation of said utilities within that certain area of the City described in Exhibit A, attached; and WHEREAS, the notice of such hearing was given to all affected property owners as shown on the last equalized tax role and to all affected utilities, in the manner and for the time required by law; and WHEREAS, such hearing was duly held, and all interested persons were given an opportunity to be heard; and WHEREAS, the City Council adopted Resolution No. 8866 on September 5, 1995 directing Staff to pursue the formation of Underground Utility District No.7; and WHEREAS, Pollard Road is a road extensively used by the general public and carries a significant volume of vehicular traffic; and WHEREAS, this proposal is in conformance with California Public Utilities Commission case law and PG&E's Rule 20A; and WHEREAS, undergrounding utilities at this time would enhance the appearance and the useful life of the Pollard Road Widening improvements and the San Tomas Area Neighborhood Park Project; and WHEREAS, the Council determined after said Hearing that the Underground Utility District herein created is in the general public interest. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell that, pursuant to Chapter 11.12 of the Campbell Municipal Code, the above-described area is hereby declared an Underground Utility District, and is designated as Underground Utility District No.7 of the City of Campbell. Attached hereto as Exhibit "B", and hereby incorporated as a part of this Resolution, is a map delineating the boundaries of said District. EXHIBIT A DESCRIPTION OF PROPOSED BOUNDARY OF UNDERGROUND UTILITY DISTRICT NO. 7 All that certain real property situate in the City of Campbell, County of Santa Clara, State of California, described as follows: Beginning at the intersection of the center of Pollard Road and the southerly prolongation of the westerly boundary of TRACT 8726; THENCE proceeding northeasterly along the southerly prolongation of the westerly boundary of TRACT 8726 and the boundary of TRACT 8726 to the northwest corner of Lot No. 1 of TRACT 8726; THENCE proceeding easterly along the northerly line of Lot No. 1 and the easterly prolongation of the northerly line of Lot No. 1 of TRACT 8726 to the easterly line of Peachtree Court; THENCE proceeding northerly along the easterly line of Peachtree Court to the northwest corner of the San Tomas Area Neighborhood Park; THENCE proceeding easterly along the northerly line of the San Tomas Area Neighborhood Park to the westerly line of Abbott Avenue; THENCE proceeding southerly along the westerly line of Abbott Avenue to intercept the westerl~ prolongation of the northerly line of the lot identlfied as APN 403-16-45; THENCE proceeding easterly along the westerly prolongation of the northerly line of said APN 403-16-45, the northerly line of said APN 403-16-45, the northerly line of the lot 10 of TRACT 6030 and the easterly prolongation of the northerly line of said lot 10 across Marsan Court to the northerly line of lot 9 of TRACT 6030; THENCE proceeding easterly along the northerly line of said lot 9, the northerly lines of the lots 8 and 7 of TRACT 6030 to the northeasterly line of TRACT 6030; THENCE proceeding southeasterly along the northeasterly boundary of TRACT 6030 and the southeasterly prolongation of the northeasterly boundary of TRACT 6030 to the center of Pollard Road; 1 EXHIBIT A THENCE proceeding westerly along the center of Pollard Road to the TRUE POINT OF BEGINNING.
