RESOLUTION NO.
8812
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CAMPBELL APPROVING A 50% REDUCTION OF PARK
IMPACT FEES FOR FIVE PARCELS LOCATED ON VAN DUSEN
LANE AND ON YORK AVENUE.
WHEREAS,the Santa Clara County Traffic Authority recorded a parcel map
consolidating remnant parcels into five legal lots of record, which comply
with the zoning requirements of the City; and
WHEREAS, Chapter 13.08 of the Campbell Municipal Code allows credits for
existing homes only if they were demolished within two years of payment of
the park fees required therein; and
WHEREAS, the homes located on the former remnant properties were
demolished by the California Department of Transportation in 1990 and 1991,
in anticipation of the construction of a significant public highway project,
Highway 85; and
WHEREAS, the timing of demolition was not under the control of the
existing owners or the property owners who owned the property prior to
acquisition by the Traffic Authority;
WHEREAS, the City Council determines the foregoing facts reduces the
reasonable relationship between the need for park facilities and the impacts of
the new development on the five parcels by 50%.
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby grants a
50% reduction of the park impact fees normally assessed under Chapter 13.08
of the Campbell Municipal Code.
