CC Resolution 8774 RESOLUTION NO. 8774 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING A FENCE EXCEPTION ALLOWING A FOUR FOOT mGH FENCE AT THE FRONT PROPERTY LINE, ON PROPERTY LOCATED AT 1265 BURROWS ROAD, IN AN R-1-10 (SINGLE FAMIL Y RESIDENTIAL) ZONING DISTRICT; APPLICATION OF JUDITH DeBERNARDI, FILE NO. E 94-04. After notification and public hearing as specified by law on the application of Judith DeBernardi, requesting a six foot high fence at the front property line, on property located at 1265 Burrows Road, in an R-1-10 (single family residential) zoning district, as per the application filed in the Planning Division on November 3, 1994; and, after presentation by the Community Development Director, proponents, and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows with respect to File No. E 94-04: 1. Approval and construction of the proposed six foot high fence will not result in a more desirable site layout for persons residing in the neighborhood and will be detrimental to the general welfare of the neighborhood because the fence will not conform with the San Tomas Area Neighborhood Plan because the visibility of the residential entryway will be screened from the public right-of-way. 2. A four foot high fence will conform with the San Tomas Area Neighborhood Plan in that the entryway will remain visible from the public right-of-way, and it will also allow visibility of any intruders and vandals. . Therefore, the CITY COUNCIL, hereby, also finds in conclusion that: 1. The establishment, maintenance, or operation of the use applied for will not be detrimental to the health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. Further, the applicants are notified as part of this application that they are required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this application and are not herein specified. And, that this approval is granted subject to the City Council Resolution No. 8774 1265 Burrows Road -- Fence Exception Adopted on February 7, 1995 Page 2 following Conditions of Approval: 1. All fencing shall be maintained in a manner that does not present a nuisance to the surrounding neighborhood. 2. Landscaping shall be placed along the fence adjacent to the street. Landscaping shall consist of vines and shrubs and is subject to the approval of the Community Development Director. 3. Applicant shall construct a gated entry feature placed away from the bus stop, subject to the approval of the Community Development Director. 4. Fencing shall not conflict with driver visibility at the intersection of Hacienda Avenue and Burrows Road.
