RESOLUTION NO. 8757
A RESOLUTION OF THE CITY COUNOL
OF THE OTY OF CAMPBELL AUTHORIZING THE MAYOR
TO EXECUTE A PROPERTY TRANSFER
AGREEMENT ON BE-HALF OF THE OTY
WHEREAS, the Campbell Union School District has sold approximately
9 acres of the San Tomas School Site to 36 Campbell Associates, L.P., to be
developed into 36 single family homesites; and
WHEREAS, 36 Campbell Associates, L.P. wishes to record a final
subdivision map in early 1995; and
WHEREAS, condition no. 15 of City Council Resolution no. 8604,
requires the School District and the City enter into a park site transfer
agreement prior to recordation of the final subdivision map for acquisition of
a 4.1 net acre parcel designated for development as a neighborhood park.
WHEREAS, in April 1994, the City Council authorized the City Manager
to negotiate a park site transfer agreement with the Campbell Union School
District and in May 1994, programmed funds in the Capital Improvement
Program for said purchase.
NOW, THEREFORE BE IT RESOLVED, that the City Council authorizes
the Mayor to execute a park site transfer agreement at a purchase price not to
exceed the amount identified in the adopted 1994-2001 Capital Improvement
Program for purchase of a 4.1 net acre park at the San Tomas School Site.
