BEING A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF CAMPBELL
RECOMMENDING APPROVAL OF A MODIFICATION TO
A PREVIOUSLY-APPROVED PLANNED DEVELOPMENT
PERMIT ALLOWING THE ADJUSTMENT IN REQUIRED
FIRE FLOW FOR A 348-UNIT APARTMENT
DEVELOPMENT LOCATED AT 500 RAILWAY AVENUE
IN A P-D (PLANNED DEVELOPMENT) ZONING
DISTRICT, APPLICATION OF MR. GILBERT MEYER
(GREENBRIAR DEVELOPMENT). FILE NO. M 93-15 (UP
PD-07).
After notification and Hearing on the application of Gilbert Meyer, on behalf
of Greenbriar Development Company, for a modification to a Condition of
Approval to a previously-approved Planned Development Permit allowing
the adjustment in required Fire Flow for a 348-unit apartment development
located at 500 Railway Avenue in a P-D (Planned Development) Zoning
District, as per the application filed in the Planning Department on December
9, 1993; and, after presentation by City Staff, proponents and opponents, the
hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. M 93-15:
General Plan and Zoning: There have been no changes in the General
Plan and Zoning in this area since the previous City Council approval of
this project on September 7, 1993.

Environmental: Environmental conditions are similar to those
previously evaluated when a Negative Declaration was granted for the
project; and

Modifications: Modifications in the site plan to accommodate fire truck
pads do not significantly impact the site layout or design.
Based upon the foregoing findings of fact, the Council further finds and
concludes that:
The proposed development and uses clearly would result in a more
desirable environment and use of the land than would be possible under
any other zoning classification.

The development and uses would be compatible with the General Plan
and Zoning Ordinances of the City and will aid in the harmonious
development of the immediate area.

The proposed development would not result in allowing more
residential units than would be allowed by other residential Zoning.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed.
Further, the applicant is notified as part of this application that he is required
to comply with the following amended Condition of Approval:

Hydrants: On-site fire hydrants are required based upon a 1,500 GPM at 20
psi fire flow. Applicant to comply with conditions state in October 7, 1993,
letter from Thomas Von Joo-Tornell, Central Fire District.
Further, the applicant is notified as part of this application that he is required
to comply with all applicable Codes and Ordinances of the City of Campbell
and the State of California that pertain to this development and are not
herein specified.
