RESOLUTION NO. 11382
BEING A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CAMPBELL REQUESTING THE LOCAL
AGENCY FORMATION COMMISSION OF SANTA
CLARA COUNTY TO ANNEX THE CENTRAL PARK
NEIGHBORHOOD INTO THE SANTA CLARA COUNTY
LIBRARY SERVICE AREA AND INTO THE WEST
VALLEY SANITATION DISTRICT INVOLVING
APPROXIMATELY 16 ACRES AND 96 PARCELS AND
INCLUSION OF THE CENTRAL PARK AND CAMBRIAN
NO. 36 NEIGHBORHOODS INTO THE WEST VALLEY
SANITATION DISTRICT SPHERE OF INFLUENCE
INVOLVING APPROXIMATELY 96 ACRES OF
PROPERTY IN TOTAL AND 428 PARCELS AS
IDENTIFIED IN THE ATTACHED MAP
After notification and public meeting, as specified by law and after presentation
by the Community Development Director, proponents and opponents, the
meeting was closed.
After due consideration of all evidence presented, the City Council did find as
follows:
1. The Council of the City of Campbell has initiated proceedings pursuant to
the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000,
Government Code Section 56000 et seq., for a reorganization which would
concurrently detach approximately 16 acres from the City of San Jose
(Central Park Neighborhood) and annex said area together with an
unincorporated island of approximately 80 acres (Cambrian No. 36 pocket)
for a combined total area of approximately 96 acres with 428 parcels.
2. The Council understands that the Community Development Director has
filed application with the Santa Clara County LAFCO for the subject
reorganization to detach approximately 16 acres from the City of San Jose
and annex said area together with an unincorporated island of approximately
80 acres for a combined total area of 96 acres with 428 parcels.
3. The Council also understands that the Executive Director of LAFCO has
reviewed the City's application and has requested that the City of Campbell
file application requesting that LAFCO approve an annexation of the Central
Park Neighborhood into the Santa Clara County Library Service Area since
the County Controller's Office uses the County Library Service Area to
define the boundaries of the County Library's property taxing authority.
4. The Council also understands that the Executive Director of LAFCO has
reviewed the City's application and has requested that the City of Campbell
file application requesting that LAFCO approve an annexation of the Central
Park Neighborhood into the West Valley Sanitation District in order for that
area to receive sewer service from the District following the territory's
annexation. Said application would further include a request to include the
Central Park Neighborhood and the Cambrian No. 36 pocket into the Sphere
of Influence of the West Valley Sanitation District.
5. The Council desires to apply for the changes necessary to effectuate the
reorganization and directs staff to file application.
6. A map of the boundaries of the approximately 16 acres of the Central Park
Neighborhood and the 80 acres of the Cambrian No. 36 pocket is attached
hereto and made a part hereof as Exhibit A.
Based upon the foregoing findings of fact, the City Council further finds and
concludes that:
1. The City Council has complied with the requirements of the California
Environmental Quality Act (CEQA), Public Resources Code Section 21000
et seq., the CEQA Guidelines, Cal. Code Regulations, tit. 14, Section 15000
et seq., finding that the project is exempt from Section 15305 which applies
to minor alterations in land use limitations and Section 15319 which allows
annexations to a city of areas containing existing public or private structures
developed to allowed densities and currently served with utility services.
2. The City Council has determined that the proposed reorganization will
promote the general health, safety and welfare of the community.
3. The City Council has determined that the reorganization, including the
annexations and detachments listed herein, is consistent with and facilitate
the fulfillment of the goals, policies and objectives set forth in the City of
Campbell General Plan, as amended.
NOW, THEREFORE, BE IT RESOLVED that the City Council requests the Santa
Clara County Local Agency Formation Commission to initiate proceedings
necessary to annex the Central Park Neighborhood into the West Valley
Sanitation District and to include said neighborhood together with the Cambrian
No. 36 Pocket Neighborhood into the Sphere of Influence of the West Valley
Sanitation District.
