RESOLUTION NO. 8711
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING THE CITY MANAGER TO FILE AN APPUCATION FOR
SURFACE TRANSPORTATION PROGRAM OR CONGESTION MITIGATION
AND AIR QUAliTY FUNDS, AND COMMITTING NECESSARY
WCAL MATCHING FUNDS
WHEREAS, the Intermodal Surface Transportation and Efficiency Act of 1991
(ISTEA) (Public Law 102-240, Dec. 18, 1991) created the Surface Transportation
Program and the Congestion Mitigation and Air Quality improvement program; and
WHEREAS, pursuant to the ISTEA, and the regulations promulgated thereunder,
eligible project sponsors wishing to receive Surface Transportation Program or
Congestion Mitigation and Air Quality improvement program grants for a project shall
submit an application first with the appropriate metropolitan transportation planning
organization (MPO), for review and inclusion in the MPO's Transportation Improvement
Program (TIP); and
WHEREAS, the Metropolitan Transportation Commission is the MPO for the San
Francisco Bay region; and
WHEREAS, the City of Campbell is an eligible project sponsor for the Surface
Transportation Program (STP) or Congestion Mitigation and Air Quality (CMAQ)
improvement program funds; and
WHEREAS, the City of Campbell wishes to submit a grant application to MTC
for funds from the STP /CMAQ program in fiscal year 1995 for the following project:
Hamilton Avenue Modification to Provide
Two Exclusive Eastbound Lanes from
Salmar Avenue to Northbound Highway 17,
including one HOV Lane
$1,090,000
WHEREAS, MTC requires, as part of the application, a resolution stating the
following:
1) the commitment of necessary local matching funds (at least 20% for bicycle
and pedestrian projects, and at least 11.5% for all other projects); and
2) that the sponsor understands that the STP /CMAQ program funding is fixed
at the programmed amount, and therefore any cost increase cannot be
expected to be funded with STP /CMAQ program funds; and 3) the assurance of the sponsor to complete the project as described in the
application, and if approved, as programmed in MTC's TIP.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell hereby authorizes the City Manager to execute and file an application for
funding under the STP/CMAQ program of the ISTEA in the amount of $1,090,000 for
the Hamilton Avenue modification to provide two exclusive eastbound lanes from Salmar
Avenue to northbound Highway 17, including one HOV lane.
BE IT FURTHER RESOLVED that the City Council of the Oty of Campbell by
adopting this resolution does hereby state that:

The City of Campbell will provide $218,000 (20%) in local matching funds;
and
The City of Campbell understands that the STP /CMAQ program funding
for the project is fixed at $872,000, and that any cost increases must be
funded by the City of Campbell from local matching funds, and that the
Oty of Campbell does not expect any cost increases to be funded with STP
or CMAQ funds; and
The Hamilton Avenue Improvement Project will be built as described in
this resolution and, if approved, as programmed in the Metropolitan
Transportation Commission (MTC) Transportation Improvement Program
(TIP).
