CC Resolution 8705 RESOLUTION 8705 BEING A RESOLUTION OF THE CITY COUNCIL AMENDING TIlE PERSONNEL RULES AND REGULATIONS WHEREAS, the City Council is authorized and directed under the provisions of the Campbell Municipal Code, Section 2.14.040, to adopt personnel rules for the administration of the personnel system; and WHEREAS, the City Council desires to amend such Personnel Rules and Regulations. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Campbell does hereby adopt the amendments outlined in the attached Exhibit A. PASSED AND ADOPTED, this 2nd day of August, 1994, by the following roll call vote: AYES: Councilmembers: Conant, Ashworth, Burr, Dougherty, Watson NOES: Councilmembers: None ABSENT: Councilmembers: None ATTEST: ~~ Anne Bybee, City Clerk EXHffiIT A SECTION 13.2 - DISCHARGE - UNCLASSIFIED MANAGEMENT PERSONNEL: Section 13.2 of the City's Personnel Rules and Regulations is modified to read: "An employee in the unclassified management service may be discharged at any time by the City Manager. In lieu of discharge, the unclassified management employee may be permitted by the City Manager to resign. Prior to the effective resignation date, the City Manager may assign the unclassified manager duties other than his/her normal duties for a period of time not to exceed three months. The decision of the City Manager shall be [mal with no right of appeal. " SECTION 13.5 - RESIGNATION OF UNCLASSIFIED MANAGEMENT PERSONNEL: Section 13.5 of the Personnel Rules currently reads: " An employee wishing to leave the unclassified management service in good standing or at his/her option under paragraph 13.2, shall fIle with the City Manager a written resignation stating the effective date and reasons for leaving at least two weeks before leaving the service, unless such time limit is waived by such official. Failure to give notice as required by this rule may be cause for denying future employment by the City. " Since Section 13.4 of the Rules addresses resignation of all employees, the above Section 13.5 is unnecessary and should be eliminated.
