CC Resolution 8699 RESOLUTION Rhqq A RESOLUTION AMENDING THE COMPENSATION AND WORKING CONDmONS FOR CLASSIFIED NON-MANAGEMENT EMPWYEFS REPRESENTED BY THE EMPWYEE ORGANIZATION ENUMERATED BEWW WHEREAS, Title 2, Section 2.12.030(7) of the Campbell Municipal Code requires the City Manager to prepare and submit an annual salary plan to the City Council for its approval; and WHEREAS, a Memorandum of Understanding for salaries, benefits and working conditions has been approved and executed by the authorized representatives of the Millmen and Industrial Carpenters, Local 262 and City Council representatives; and WHEREAS, as the City Council of the City of Campbell desires to ratify and adopt the provisions included in the Memorandum of Understanding attached. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Campbell does hereby approve and ratify the Memorandum of Understanding attached hereto, and made a part hereof. Burr Chairperson Pro Tern ATTEST: ~~ Anne Bybee, City Clerk MEMORANDUM OF UNDERSTANDING ON WAGE, EMPWYEE BENEFITS, HOURS AND OTHER TERMS AND CONDITIONS OF EMPWYMENT PARTIES TO UNDERSTANDING This Memorandum of Understanding is between the authorized representatives of the City Council of the City of Campbell, hereinafter referred to as "City," and the authorized representatives of Millmen and Industrial Carpenters. Local 262. hereinafter referred to as "MIC. " STATE LAW COMPLIANCE This Memorandum of Understanding complies with the provisions of the State of California Public Employees Representation Law, as contained in Section 3500 of the Government Code of the State in that the employer-employee representatives noted here did meet and confer in good faith and did reach agreement on those matters within the scope of representation. This Memorandum of Understanding also complies with Resolution 6647, relating to employer-employee relations, as adopted and amended by the City Council of the City of Campbell. I. GENERAL CONDITIONS A. Personnel Rules and Regulations This Memorandum of Understanding does not modify or change the provisions of the Personnel Rules and Regulations of the City unless a specific reference is made herein to modify or add to the existing Personnel Rules and Regulations. B. Terms of Understanding This Memorandum of Understanding embodies all modifications on salaries, hours, employee benefits, and other terms and conditions of employment, for a 24-month term beginning July 1, 1994 and ending June 30, 1996. C. Existing Benefits Continued This Memorandum of Understanding does not modify existing salaries, benefits, hours, or terms and conditions of employment contained in the currently adopted Pay and Classification Plan, except as noted herein. Such benefits and terms of employment remain unmodified and shall continue in full force and effect throughout the term of this Memorandum of Understanding. MIC Page 2 I. GENERAL CONDmONS (cont.) D. Effective the first day of the first pay period of July 1994, the salaries of all classifications represented by MIC shall be increased by four percent (4 % ). ill. OTHER PROVISIONS A. 2 % At 55 PERS Plan Modification Effective the first day of the first pay period of July, 1995, the City will provide the 2 % at 55 PERS plan, contingent upon a PERS employer rate additional cost of no more than four percent (4%). Should this benefit not be accepted by all bargaining units that represent Miscellaneous employees, this benefit will not be provided. If the additional employer rate for 2% at 55 exceeds four percent (4%), or if the 2 % at 55 PERS benefit is not accepted by all bargaining units that represent Miscellaneous employees, the City makes the following compensation adjustment proposal: Effective the first day of the first pay period of July 1995, salaries of all classifications represented by MIC shall be increased by an amount equal to one hundred per cent (100%) of the increase in the San Francisco/Oakland/San Jose Urban Wage Earner and Clerical Worker Consumer Price Index for the one year period from May 1, 1994 through Aplil30, 1995, with a maximum salary increase of four percent (4 %) and a minimum salary increase of two percent (2%). MIC Page 3 m. OTHER PROVISIONS (cont.) B. Benefit Cost Adjustments July 1. 1994 The City will be responsible for any increase to the PERS employer contribution rate. The City will contribute an additional $4.59 per month for dental coverage (current plan), bringing the monthly dental contribution to $58.06. The City will increase the contribution for life insurance to $8.00 per month. The City will continue the existing contribution of $6.55 per month for the Employee Assistance Program. The City will contribute an additional $12.00 per month (effective as soon after July 1, 1994 as possible) for Long Term Disability Insurance and the maximum benefit will be increased from $1,333 per month to $2,000 per month. This increased benefit level will only be effective if all affected bargaining units accept the LID modification. July 1. 1995 The City will be responsible for any increase to the PERS employer contribution rate, except any employer contribution rate increase associated with the 2 % at 55 PERS plan that exceeds the maximum agreed upon increase specified in Section ill.A of this M.O.U. The City will be responsible for any increase in dental insurance costs. The City will be responsible for any increase in life insurance costs. The City will be responsible for any increase in Employee Assistance Program costs. The City will be responsible for any increase in Long Term Disability costs. The City will increase the uniform allowance to all employees represented by MIC, with the exception of the Mechanic IT and Equipment Maintenance Supervisor to $415.00 per fiscal year. Health Insurance Benefit Program In the spirit of cost containment, effective August 1, 1994, the Lifeguard Insurance will be changed from the current A/Rx4 plan to the A5/Rx5 plan. Effective August, 1994, the City proposes to provide a maximum of $400 per month for health insurance (increase of $14.85 per month). Any unused portion of the health insurance allotment will be rebated to the employee, up to a maximum of $190 per month. D. Holidays Effective January, 1995, Martin Luther King, Jr. Day will be observed as a City holiday and MIC represented employees will receive the day as a paid holiday. Effective December 1995, the one additional holiday at Christmas, designated each year by the City Manager, will be discontinued. E. Tool and Shoe Allowance - Mechanic II and Equipment Maintenance Supervisor Effective July, 1994, the Mechanic II and Equipment Maintenance Supervisor will receive a shoe allowance of $125.00 annually to be paid in July. The maximum tool reimbursement per fiscal year will be increased to $125.00. All other provisions of the tool replacement policy will remain unchanged. IV. MODIFICATIONS TO PERSONNEL RULES AND REGULATIONS The following sections of the Personnel Rules and Regulations will be modified as follows: A. Section 16.2 Vacation Accrual Rates: Years of Service Start of Year 1 through completion of Year 4 Start of Year 5 through completion of Year 10 Hours Accrued Per Pay Period 3.38 (11 days) 4.92 (16 days) All other provisions of Section 16.2 shall remain unchanged. B. Section 17.17. Working Out of Class Pay -- Public Works Maintenance Division Nonmanagement Personnel Section 17.17 will be modified (second sentence) to read: "Employees required to serve in an acting capacity in the higher classifications of Park Maintenance Supervisor, Street Maintenance Supervisor, Equipment Maintenance Supervisor or Senior Lighting & Traffic Signal Technician shall receive an additional $15.00 per day." All other provisions of Section 17.17 shall remain unchanged. , . l MIC Page 5 IV. MODIFICATIONS TO PERSONNEL RULES AND REGULATIONS (cont) C. Section 17.20. Meal Reimbursement -- Public Works Maintenance Division Nonmanagement Personnel In compliance with Federal and California tax law, Section 17.20 of the Personnel Rules and Regulations will be modified to read as follows: "Public Works maintenance nonmanagement employees represented by Millmen and Industrial Carpenters, Local 262, will receive a meal allowance of $9.00 when required by a supervisor to work a three hour or longer extension of the normal shift. Employees working such a shift extension shall schedule their meal breaks in a manner that is least disruptive to the work being performed during the shift extension, and meal breaks will not exceed fifteen minutes. Payment will be made through the City payroll system, following the appropriate entry on the employee's timecard." V. RETROACTIVITY All proposals will be effective as indicated if agreement is reached by July 15, 1994. If agreement is not reached by July 15, 1994, compensation adjustments will not be effective until the first day of the first pay period following City Council ratification of a Memorandum of Understanding. VI. RA TIFICA TION This M.O.U. is subject to ratification by a majority vote of the employee organization represented herein within ten (10) days of execution by MIC and by approval of a majority of the City Council of the City of Campbell within twenty (20) days of the date of execution.
