RESOLUTION NO. 8692
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
AUTHORIZING AND RELEASING IMPROVEMENT AGREEMENT
AND AUTHORIZING THE MAYOR TO EXECUTE THE
NOTICE OF RELEASE ON BEHALF OF THE CITY
WHEREAS, the City of Campbell entered into an Agreement for installation of
street improvements at 746 Emory Avenue, recorded November 7, 1983, in Book 1047 of
Official Records at Pages 94 through 98 in the Office of the County Recorder of the County
of Santa Clara, State of California; and
WHEREAS, on November 2, 1993, the City Council adopted Resolution No. 8574,
approving the San Tomas Area Neighborhood Plan; and
WHEREAS, the property owners of the subject property have requested that the City
release the property from the obligations of the Street Improvement Agreement; and
WHEREAS, the City Engineer and the Public Works Director have reviewed the
request of the owners and have concurred and recommended that the request is pursuant
to Resolution No. 8574;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Campbell does hereby release the conditions of said Agreement and does hereby authorize
the Mayor to execute the Notice of Release on behalf of the City and authorizes the City
Clerk to record the Notice.
BE IT FUR THER RESOLVED that the Public Works Director is hereby authorized
to execute all future Notices of Release pertaining to Deferred Street Improvement
Agreements in the San Tomas neighborhood, and that the City Clerk is authorized to record
said documents with the County Recorder's Office.
