CC Resolution 8664 RESOLUTION NO. 8664 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING THE REINSTATEMENT OF A PREVIOUSLY APPROVED TENTATIVE PARCEL MAP (PM 92-03) ALLOWING THE CREA TION OF FIVE LOTS (FOUR TOWNHOME LOTS AND ONE LOT DEVELOPED AS A COMMON DRIVEWAY) ON PROPERTY LOCATED AT 875 APRICOT A VENUE IN A PD (PLANNED DEVELOPMENT-HIGH DENSITY RESIDENTIAL) ZONING DISTRICT. APPLICATION OF MR. JAMES CHEN. FILE NO. R 94-02 (PM 92-03) After public notification, as specified by law, for the application of Mr. James Chen, S.C.T. Development Inc., for approval of a reinstatement of a previously-approved Tentative Parcel Map allowing the creation of five lots on property located at 875 Apricot Avenue, as per the application filed in the Planning Department on April 7, 1994, and after presentation by the Planning Director, the City Council did find, with regard to File No. PM 94-01: 1. The proposed map is located in a Planned Development Zoning District and is consistent with the approved Planned Development Permit. 2. The General Plan designates this area as High Density Residential ( 21 to 27 per gross acre). The proposed project will be developed at 14 units per gross acre. Based on the foregoing findings of fact, the City Council further finds and concludes that, subject to the imposed conditions: 1. This Tentative Parcel Map, together with the provisions for its design and improvement, is consistent with the General Plan of the City of Campbell. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. 1. Revised Plan: Revised site plan indicating location of fire hydrant to be submitted to the Planning Department and approved by the Planning Director upon recommendation of the Fire Department prior to application for a building permit. (Planning) 2. Title Report: Provide a copy of the preliminary title report. (Public Works) Resolution No. 8664 R 94-02 (PM 92-03) -- 875 Apricot Avenue Page 2 STREET/SITE IMPROVEMENTS 3. Street Improvements: Dedicate additional right-of-way to widen Apricot Avenue to 30 feet from centerline. Street improvements shall be constructed as directed by the City Engineer. (Public Works) 4. Encroachment Permit: Submit street improvement plans, pay fees, post surety and deposits as needed to obtain the encroachment permit required for all work within the public right-of-way as directed by the City Engineer. (Public Works) 5. Grading and Drainage: Provide grading and drainage plans for review by the City Engineer. (Public Works) PROPERTY MANAGEMENT/UTILITIES 6. Sewer: Installation of a sanitary sewer system to serve all lots within the subdivision in conformance with the proposed plans of the West Valley Sanitation District No.4. Sanitary sewerage service shall be proved by District No.4. (Public Works) 7. Water: Installation of a water distribution system to serve all lots within the subdivision in conformance with the plans of the San Jose Water Works. Water service shall be provided by the San Jose Water Works. (Public Works) PUBLIC SAFETYIWELFARE 8. Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) 9. Park Dedication Fee: Applicant shall be fees of $9,096 (2 new units @ $4,548 each) for park dedication. (Public Works) 10. Code. Covenants & Restrictions: Code, Covenants and Restrictions (CC & R's) shall be approved by the City Engineer to ensure provisions for maintenance of buildings and common area. (Public Works) 11. Parcel Map: Applicant shall file and process a Parcel Map.
