RESOLUTION NO. 8648
RESOLUTION OF THE CITY OF CAMPBELL CONSENTING TO
INCLUSION OF THE TERRITORY OF THE CITY IN THE
FORMATION OF THE COUNTY LIBRARY SERVICE AREA
WHEREAS, the Board of Supervisors of Santa Clara County is preparing
an application to the Local Agency Formation Commission for the creation of a
County Service Area for enhanced library services (hereinafter "County library
Service Area"); and
WHEREAS, the Board of Supervisors requests each city within the County
Library District to adopt a resolution of consent for inclusion of its territory in the
formation of the County library Service Area pursuant to Section 25210.10(a) of
the Government Code; and
WHEREAS, the County and City agree to the formation of a Joint Powers
Authority to govern the provision of library services; and
WHEREAS, upon creation of the County library Service Area, approval of
the Joint Powers Authority governing board and LAFCO, and passage of an
advisory measure by the electors of the County Service Area, the Board of
Supervisors could levy a benefit assessment upon property in the County library
Service Area; and
WHEREAS, this Council finds that the public health, safety and economic
welfare of its constituency will be promoted by participating in the proposed County
library Service Area.
NOW, THEREFORE, BE IT RESOLVED that this Council:
1. Approves and consents to the inclusion of all of the incorporated
territory of the City in the formation of the County library Service Area; and
2. Approves and consents to a levy by the County of a benefit
assessment for library services as approved by an advisory vote of the electors of
the County library Service Area; and
3. Directs the Clerk to file certified copies of this resolution with the
Clerk of the Board of Supervisors and with the County Executive of the County of
Santa Clara.
