RESOLUTION NO. 8618
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CAMPBELL, CALIFORNIA, ADOPTING THE PLAN FOR
THE PURCHASE OF SURPLUS SCHOOL PROPERTY
PURSUANT TO THE PROVISIONS OF THE NAYLOR ACT,
FOR THE CONSIDERATION OF PARK SITE ACQUISITION
ON A PORTION OF THE PROPERTY LOCATED AT 1510
HACIENDA A VENUE (FORMER SAN TOMAS SCHOOL
SITE), PER ATIACHMENT "A".
After notification and public hearing as specified by law on the proposed
adoption of the Plan for the Purchase of Surplus School Property, and after
presentation by the Community Development Director, proponents and
opponents, the public hearing was closed.
No substantial evidence has been presented that shows that the proposal
could have a significant adverse impact on the environment. The proposed
Plan is exempt from the CEQA Guidelines pursuant to Sections 15061, and
15378.
After due consideration of all evidence presented, the City Council does find
as follows, with respect to the Plan for the Purchase of Surplus School
Property:
1. The City Council finds that acquisition of the proposed park site is
consistent with the City's need for park lands and the Open Space
Element of the General Plan, in that it will provide 4.1 acres of open
space for public use.
2. The City Council finds that public lands in the vicinity of the school site
are inadequate to meet the existing and foreseeable needs of the
community for playground, playfield, or other recreational and open
space purposes.
Based upon the foregoing findings of fact, the City Council further finds and
concludes that:
1. The proposed park site acquisition will not be detrimental to the health,
safety, peace, morals, comfort or general welfare of the persons residing
or working in the neighborhood, or be detrimental or injurious to
property and improvements in the neighborhood or to the general
welfare of the City.
The City Council does hereby adopt a Resolution adopting the Plan for the
Resolution No. 8618
Adopted March 1, 1994
Purchase of Surplus School Property, enabling the City to exercise an option
agreement with the Campbell Union School District for the purchase of the
park site as indicated on Exhibit "A," (attached), pursuant to the provisions of
the Naylor Act.

San Tomas School Site
INTRODUCTION
This Plan for the Purchase of Surplus School Property has been prepared
pursuant to the guidelines of the Naylor Act (Act), to allow the City of Campbell
the opportunity to acquire former school site properties for use as open space or
park land. The Act specifies the manner in which the City must declare an
interest in a property that a school district has determined to be surplus. In
addition, it outlines a formula for determining the price of the land in question.
Currently there are approximately 37,000 residents in the City of Campbell.
Pursuant to existing General Plan criteria there is a need for approximately 96
acres of useable open space (103 acres at the City's current projected build-out
point). The City's open space system currently provides 75 acres of open space,
which is approximately 78% of what General Plan policy requires. In order for the
City to comply with General Plan standards there is a current need for 21 acres,
and at the City's build-out point there will be a need for 7 additional acres of
useable open space, for a total of 28 acres.
The challenge for the City of Campbell is to provide open space commensurate
with General Plan policies, recognizing the fact that the City does not have an
abundance of undeveloped land area for open space consideration. By utilizing
portions of existing school facilities, the City may have an opportunity to provide
additional park space in areas constrained by development.
BACKGROUND
Based on the findings of the October 23, 1989, report of the Facilities Advisory
Committee, the Campbell Union School District (the District) recommended that
a number of the District's facilities not be held for future educational purposes
Clandbanked). That report includes the previously closed San Tomas Elementary
School site. The site consists of 13.16 acres and includes several former classroom
structures, playfields, and a Little League facility. In the report, the District
determined that the site should be made available for disposition. In its
justification for not keeping the property, the District cites declining enrollment
figures, poor physical condition of the existing facilities, and high renovation
costs. The District also decided that selling the site would be more advantageous
than leasing the site, again because of the poor condition of the facility, and
because of the value of the underlying property.
Pursuant to its report, the District submitted an application in August of 1993 for
a 37 lot subdivision including 36 single-family homes and a 3.85 acre park site. The
project was reconfigured after several neighborhood meetings, to place the
proposed park at the southern end of the project area. The reconfiguration
resulted in the addition of approximately .25 acres to the park site for a total of 4.1
acres, without a reduction in the number of residential lots (Exhibit A). The

proposed 4.1 acre park site is the property that will be acquired by the City of
Campbell pursuant to the provisions of the Naylor Act.
OPEN SPACE ELEMENT
The Open Space Element of the General Plan includes a Neighborhood Analysis
that identifies each of the neighborhoods within the City, and what the
corresponding park needs are for that neighborhood. That analysis indicates that
3.9 acres of park land are needed in the San Tomas neighborhood. The City has
identified approximately 4.1 acres of the former school site for acquisition. The
proposed 4.1 acres will provide park land in excess of the need identified for the
San Tomas neighborhood.
Open Space Implementation Plan: In December of 1993 the City Council
adopted an Open Space Implementation Plan. Part of that plan includes direction
for City staff to complete a Plan for the Purchase of Surplus School Property, and
to Take the necessary steps to acquire the portion of the San Tomas school site
eligible under the Naylor provisions. This Plan has been prepared in response to
the direction of the City Council, and pursuant to the requirements of the Naylor
Act.
GENERAL SITE INFORMATION
Vicinity: The entire project site is generally bounded by Hacienda Avenue to the
north, Pollard Road to the south, Abbott Avenue to the east, and the terminus of
Walters Avenue to the west (Exhibit B). The project site is surrounded by single-
family residential uses on the north, east, and west sides. South of the site is a
planned development consisting of high density residential land uses, located
within the City of Los Gatos. Pursuant to the approved tentative map for the
former school site, the proposed park will be surrounded by residential streets.
Single-family homes will face the park on the three sides that are within the City of
Campbell.
The area that would experience the greatest amount of benefit from the City' s
acquisition of the school site is the neighborhood surrounding the former school.
Indirectly, the City as a whole would benefit because the site could provide over
four acres of new open space. As previously determined, the City currently has a
21 acre open space deficiency.
Location: The former San Tomas School site is located in the southwestern
portion of the City of Campbell, adjacent to the Town of Los Gatos which is south
of the project area. Goal 1, Policy 1.3 of the Open Space Element of the General
Plan states, Strive to provide park facilities within a one-quarter to one-half mile
radius of all City residents (Exhibit C). The nearest accessible city park in the San
Tomas School neighborhood located within the City of Campbell is John D.
Morgan Park which is over one mile away from the proposed site. An additional

park site in the vicinity of the San Tomas neighborhood is located to the north of
the area in the City of San Jose. That park is nearly one mile from the proposed
San Tomas park site. In addition, it is necessary to cross major thoroughfares to
access these parks.
Because of their distance from the neighborhood in question, the two parks do
not serve the southwestern portion of the City as well as the proposed school site
would. Acquisition of a portion of the former San Tomas School Site would fulfill
the above stated General Plan policy for the southwesterly portion of the San
Tomas neighborhood.
Site Description: The existing school facility ceased operation in 1979. Since that
time the District has not utilized the site for instruction purposes. The northerly
portion of the site, adjacent to Hacienda Avenue, supports all of the classrooms
and administrative offices of the former school. The central portion of the site
contains former playground facilities and athletic fields. The southern portion,
which is fenced off from the school yard, supports Quito Little League s four
playing fields.
The portion of the site under consideration is the southeastern 4.1 acres of the
former school site (see attached map, Exhibit A). The southern half of the
proposed park site contains four baseball fields that have been utilized by Quito
Little League. The northern portion contains open area that was used as athletic
and play fields by the former school.
PLAN FOR PURCHASE
Pursuant to the Naylor Act the City is able to acquire 30% of the District's surplus
school site area at the rates outlined in the Act. The 30% limit would allow the City
to acquire 3.86 acres at Naylor Act rates, the City of Campbell proposes to acquire
a total of 4.1 acres of park. The 30% that the City proposes to acquire is located in
the southeasterly portion of the former San Tomas School site, as shown on
Exhibit A, attached. The remaining portion of the site is not to be included for
acquisition consideration.
The method for determining the purchase price of the subject property is
dictated by the provisions of the Naylor Act, and the final price of the proposed
park site will be determined by appraisals that will be conducted prior to the
time of the sale. If the City Council adopts this plan, it will be empowered by
virtue of the Naylor Act to enter into an option agreement with the District for
purchasing the proposed 4.1 acre park site.
ENVIRONMENTAL DETERMINATION
The Planning Department staff has determined that the adoption of this purchase
plan is exempt from the CEQA Guidelines pursuant to sections 15061 and 15378.

The City Council consideration of the Plan for Purchase of Surplus School
Property neither grants an entitlement for development purposes nor does it
bind the City to grant such entitlements. The Plan enables the City to option the
site for purchase only, pursuant to the provisions of the Naylor Act. As such, the
activity does not meet the definition for a project according to the CEQA
Guidelines. At such time as the City considers actual park site development or
any construction related improvements to the park site, further environmental
review may be required.
