A RESOLUTION AUTHORIZING APPLICATION FOR TRANSPORTATION
ENHANCEMENTS ACTIVITIES FUNDING FOR LOS GATOS CREEK
TRAIL WIDENING AND DECLARING INTENT TO PROVIDE LOCAL
MATCHING FUNDS
WHEREAS, the Intermodal Surface Transportation and Efficiency Act of 1991 (ISTEA)
(Public Law 102-240, Dec. 18, 1991) created the Transportation Enhancements Activities
(Enhancements) program as a part of the Surface Transportation Program (23 U.S.c.s 133);
and
WHEREAS, a portion of the Surface Transportation Program funds are set aside for the
Enhancements program; and
WHEREAS, pursuant to the ISTEA, and the regulations promulgated thereunder, eligible
project sponsors wishing to receive Enhancements program grants for a project shall submit
an application first with the appropriate metropolitan transportation planning organization
(MPO), for review and inclusion in the MPO's Transportation Improvement Program (TIP);
and
WHEREAS, the Metropolitan Transportation Commission IS the MPO for the San
Francisco Bay region; and
WHEREAS, the City of Campbell is an eligible project sponsor for Enhancements program
funds; and
WHEREAS, the City of Campbell wishes to submit a grant application to MTC for funds
from the Enhancements program in fiscal year 1994 for the following project:
Los Gatos Creek Trail Widening
Campbell Avenue to San Tomas Expressway
$198,000
WHEREAS, MTC requires, as part of the application, a resolution stating the following:
1) the commitment of necessary local matching funds (at least 20% for bicycle
and pedestrian projects, and at least 11.5% for all other projects); and
2) that the sponsor understands that the Enhancements program funding is fixed
at the programmed amount, and therefore any cost increase cannot be
expected to be funded with Enhancements program funds; and
3) the assurance of the sponsor to complete the project as described in the
application, and if approved, as programmed in MTC's TIP.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Campbell that
the Public Works Director is authorized to execute and file an application for funding under
the Enhancements program of the ISTEA in the amount of $198,000 for Los Gatos Creek
Trail Widening, Campbell Avenue to San Tomas Expressway.
BE IT FURTHER RESOLVED that the City of Campbell by adopting this resolution does
hereby state that:
1) The City of Campbell will provide $49,500 (20%) in local matching funds; and
2) The City of Campbell understands that the Enhancements program funding
for the project is fixed at $198,000, and that any cost increases must be funded
by the City of Campbell from local matching funds, and that the City of
Campbell does not expect any cost increases to be funded with Enhancements
funds; and
3) The Los Gatos Creek Trail Widening will be built as described in this
resolution and, if approved, as programmed in Metropolitan Transportation
Commission (MTC) Transportation Improvement Program (TIP).
BE IT FURTHER RESOLVED that a copy of this resolution will be transmitted to the
MTC in conjunction with the filing of the application; and
BE IT FURTHER RESOLVED that the MTC is requested to support the application for
the project described in the resolution and to program the project, if approved, in MTC's
TIP.
