BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CAMPBELL, RATIFYING PLANNING COMMISSION
APPROVAL OF A REINSTATEMENT TO A PREVIOUSLY
APPROVED PLANNED DEVELOPMENT PERMIT TO ALLOW
CONSTRUCTION OF THREE TOWNHOME UNITS, IN A PD
(PLANNED DEVELOPMENT) ZONING DISTRICT.
APPLICA nON OF MR. STEVE SARA Y. FILE NO. R 93-04 (PD 89-
16).
After notification and Public Hearing as specified by law on the application of Mr. Steve
Saray, for approval of a Reinstatement to a previously approved Planned Development Permit
to allow construction of three townhome units on property located at 65-85 E. Latimer
Avenue, in a PD (Planned Development) Zoning District; and, after presentation by the City
Staff, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council does hereby ratify the
Planning Commission's action per Application File No. R 93-04 (PD 89-16), including the
findings and the Conditions of Approval outlined in Resolution No. 2885, adopted by the
Planning Commission on November 9, 1993, with the additional condition as follows:
23. Surety to Guarantee Property Conditions: Applicant shall post a surety in favor of the
City in the amount of $1,500 in a form and content sufficient to guarantee the repair,
remedy, redesign, replacement and/or abatement of any and all nuisance conditions as
defined in Campbell Municipal Code Section 6.10.020, existing on the project site at
any time between the approval of this Planned Development application and ninety (90)
days following the issuance of the Certificate of Occupancy for the final unit of the
project. (City Council)
Further, the applicant is notified as part of this application that he is required to comply with
all applicable Codes and Ordinances of the City of Campbell and the State of California which
pertain to this development and are not herein specified.
