CC Resolution 8489 RESOLUTION NO. 8489 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL DECLARING ITS INTENTION TO LEVY AND COLLECT ASSESSMENTS WITHIN CITY OF CAMPBELL LIGHTING DISTRICT LLA-1 FOR FISCAL YEAR 1993-1994 WHEREAS, the City Council did, pursuant to the provisions of the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the Streets and Highways Code of the State of California, conduct proceedings for the formation of the City of Campbell Lighting District LLA-1 and for the levy and collection of Assessments for Fiscal year 1980-1981, and did, on June 23, 1980, pursuant to proceedings duly had, adopt its Resolution No. 5381, a Resolution Overruling Protests and Ordering the Formation of an assessment District and the Improvements and Confirming the Diagram and Assessment; WHEREAS, the public interest, convenience and necessity require, and it is the intention of said Council to undertake proceedings for the levy and collection of assessments upon the several lots or parcels of land in said District, for the construction or installation of improvements, including the maintenance or servicing, or both, thereof for the Fiscal Year 1993-1994; and WHEREAS, the City Council has given preliminary approval to report of the engineer which is on file with the City Clerk; NOW, THEREFORE, BE IT RESOLVED as follows: 1. The City Council declares that it intends to levy and collect assessments within the boundaries of City of Campbell Lighting District LLA-1 for Fiscal Year 1993- 1994, except that such assessments shall not be imposed upon a Federal or State Governmental agency or another local agency. 2. The existing and proposed improvements are generally described in Exhibit A to this Resolution, along with any substantial changes proposed to be made in existing improvements; 3. The assessment district, distinctly referred to as City of Campbell Lighting District LLA-1, is generally located in all the area within the City Limits of the City of Campbell; 4. The Engineer's Report setting forth a full and detailed description of the improvements, the boundaries of the assessment district, and the proposed assessments upon assessable lots and parcels of land within the district, is on file with the City Clerk and available for viewing by the public; 5. The City Council shall hold a hearing on the levy of the proposed assessment at the regular Council meeting on May 18, 1993, at 7:30 p.m., or as soon thereafter as the matter may be heard in the Council Chambers at Campbell City Hall, 70 North First Street, Campbell, California 95008. 6. Thereafter, the City Council shall hold a second public meeting on the levy of the proposed assessment at the regular Council meeting on July 6, 1993 at 7:30 p.m., or as soon thereafter as the matter may be heard, in the Council Chambers at Campbell City Hall, 70 North First Street, Campbell, California 95008. Conant, Mayor ATTEST: tL~ Anne Bybee, City Clerk EXHIBIT A Description of Work The construction, installation, maintaining and servicing of public light facilities including standards, luminaries, poles, conduits, wires, transformers, attachments and appurtenances, the furnishing of electric current or energy, and any expenses incidental thereto. The maintaining and servicing of trees, shrubs, grass, other ornamental vegetation and appurtenances, including repair, removal or replacement of all or any part thereof, providing for the life, growth, health and beauty of landscaping, including cultivation, trimming, spraying, fertilizing, treating for disease or injury, the installation and construction of curbs, gutters and sidewalks, park and recreational improvements, the removal of trimmings, rubbish, debris and other solid waste, water for irrigation and any expenses incidental thereto.
