RESOLUTION NO. 8465
BEING A RESOLUTION OF THE CITY OF CAMPBELL
AUTHORIZING THE ABATEMENT OF A NUISANCE AT
65-85 E. Latimer Ave., Campbell, CA
WHEREAS, the City of Campbell City Council on Mar. 2, 1993 set a
public hearing on this matter for Mar. 16, 1993; and
WHEREAS, the owner and the bank furnishing funds for construction of
these townhomes have been notified of the public hearing for Mar. 16,
1993; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Campbell that the Mayor and the City Clerk authorize the use of
police powers to enforce the abatement of said nuisance. Any cost
involved with the authorization shall become a lien upon those
properties not abating the nuisance voluntarily, such lien shall be
recorded with the County Tax Assessor's Office.
Based on the evidence presented at the Council meeting on March 16,
1993 the City Council finds the accumulated trash and construction
debris not voluntarily removed constitute a public nuisance in that
they are maintained ln such a manner so as to be injurious to the
health and safety of the public as follows:
1. Constitutes a fire hazard or a condition dangerous to the public
health, safety and general welfare;
2. Constitutes an unsightly appearance or otherwise detracts from
the aesthetic or property values of the neighboring properties;
NOW, THEREFORE, be it further resolved by the city Council of the
City of Campbell orders that the owners, or other persons having
charge or control of the premises abate the nuisance within thirty
(30) days from the date of this order by the following methods:
Obtain a large debris box from Green Valley Disposal Company and
remove all accumulated trash and construction debris on this site and
complete the project as per approved plans.

If the nuisance is not completely abated within the thirty (30) days
by the owner or person having charge or control of the premises, then
city officials are authorized to cause the nuisance to be abated by
city forces or private contract and assess the owner or his property
for the costs incurred.
