CC Resolution 8446 RESOLUTION NO. 8446 A RESOLUTION OF THE CITY OF CAMPBELL APPROVING EXECUTION OF A PARKING LICENSE AGREEMENT WITH FRY'S ELECTRONICS WHEREAS, the City of Campbell owns a parcel of land (the ''Property'') on Hamilton Avenue more fully descnbed in the attached Exhibit A; and WHEREAS, Fry's Electronics ("Fry's") wishes to utilize a portion of the Property to provide additional parking in conjunction with their retail use on the adjacent property; and WHEREAS, the City of Campbell wishes to allow Fry's to utilize a portion of the Property for parking; and WHEREAS, a Parking License Agreement (the "Agreement") has been prepared which would allow Fry's to utilize a portion of the Property for parking, and a form of which is on file with the City Clerk; and WHEREAS, the City of Campbell Redevelopment Agency has approved a negative declaration (the "Negative Declaration") which assesses the environmental effects of, and has served as the environmental documentation pursuant to the California Environmental Quality Act ("CEQA") for, the activities proposed to be undertaken under the Agreement; and WHEREAS, the City Council of the City of Campbell (the "City Council") has served as a "Responsible A~ency" under CEQA with respect to the Negative Declaration in consIdering its actions pursuant to this Resolution. WHEREAS, the City Council has complied with the requirements for a Responsible Agency in the review and consideration of the Negative Declaration in accordance with the requirements of the State CEQA Guidelines (14 Cal. Code of Regulations, Section 15096) and the City's adopted local CEQA Implementation Guidelines (the ''Local Guidelines"). NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Campbell hereby certifies its review and consideration of the Negative Declaration in accordance with CEQA, the State CEQA Guidelines and the Local Guidelines. BE IT FURTHER RESOLVED that the City Council of the City of Campbell hereby finds and determines that the Negative Declaration adequately addresses the environmental issues pertaining to the Agreement and the transactions contemplated therein, and properly concludes that the Agreement and the transactions contemplated therein will not have a significant effect on the environment; therefore, no further findings are required to be made by the City Council pursuant to 14 Cal. Code of Regulations, Section 15096(h). BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to file a Notice of Determination in accordance with 14 Cal. Code of Regulations, Section 15096(i). BE IT FURTHER RESOLVED by the City Council that the City Manager is hereby authorized to execute the Agreement, substantially in the form on file WIth the City Clerk.
