CC Resolution 8443 RESOLUTION NO. 8443 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING A SITE AND ARCHITECTURAL PERMIT TO ALLOW A FREEWAY ORIENTED SIGN FOR PROPERTY LOCATED AT 600 EAST HAMIL TON A VENUE, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT; APPUCA nON OF FRY'S ELECTRONICS STORE, FILE NO. SA 92-45 After notification and Public Hearing as specified by law on the application of Fry's Electronics Store approving a Site and Architectural Permit to allow a freeway oriented sign for property located at 600 East Hamilton Avenue, in a PD (Planned Development) Zoning District, as per the application filed in the Planning Department on November 12, 1992; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council does hereby ratify the Planning Commission's action per Application No. SA 92-45, including the findings (Exhibit A), and the Conditions of Approval (Exhibit B) outlined in Resolution No. 2830 (Exhibit C) adopted by the Planning Commission on November 24, 1992. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified. Hamilton Avenue Fry's Electronics, Inc. December 7, 1992 The Planning Commission finds as follows with regard to project number SA 92-45. 1. The proposed size of the sign is reasonable given the limited frontage (less than 150 feet) on an arterial street, and setback distance of 300 feet from the building to the street and is of appropriate scale to reasonably identify the business location. 2. The maximum sign height and area is reasonable for a development exceeding 7 acres and a retail store in excess of 60,000 square feet. 3. Additional signage in excess of what is permitted in the Sign Ordinance is appropriate for this development due to the site having frontage on two streets and Highway 17. 4. The additional freeway oriented sign will aid in identifying and directing traffic for this site. 5. Fry's Electronics is a regional retailer and relies upon the freeway exposure to identify the store location. 6. The site is obscured by it's limited frontage on Hamilton Avenue and numerous trees along the freeway right-of-way. Based upon the foregoing findings of fact, the Planning Commission finds and concludes that: 1. The use is of such size and is so located in reference to surrounding uses and the traffic circulation system that additional signage is warranted. 2. The proposed signage is in keeping with the principles and purposes of the sign ordinance. 3. The signs would not be detrimental to the public welfare or persons in the neighborhood or the City as a whole. 4. The proposed freeway sign is limited to the identification of the on-site business. 5. The business market area is regional in nature and the business operation is dependent upon freeway identification. 6. Denial of the sign would cause an undo hardship due to the site size, location and limited visibility. Conditions of Approval Exhibit B SA 92-45 Site and Architectural Approval for a freeway oriented sign 600 E. Hamilton Avenue Fry's Electronics, Inc. Revised 2/1/93 December 7, 1992 The applicant is hereby notified, as part of this application, that they are required to meet the following conditions in accordance with the Ordinance of the City of Campbell and the State of California. Additionally, the applicant is hereby notified they are required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California which pertain to this development are not herein specified. 1. The sign location shall be substantially as shown on the site plan labelled Campbell/Fry's Electronics site map "Location #4." 2. Permits: Applicant shall obtain any necessary electrical or building permi ts. 3. Sign Illumination: Approval is granted to illuminate the sign letters only. The background area shall not be illuminated. The intensity of the sign illumination shall be no brighter than the Pruneyard Inn/Campbell Inn sign. The sign letters shall not blink or otherwise be animated and shall be illuminated only during Fry's business hours. 4. Sign Design: The sign design is not approved. The design of the sign cabinet and support structure shall be modified to conform to the architectural design elements planned for the building entrance or an alternate design concept to be reviewed and approved by the Planning Director. The letters of the sign shall be the only illuminated portion of the sign and shall comprise not more than 35 percent of the sign face. The background of the sign shall be a textured material (non- illuminated) and the design of the sign supports and framing shall be architecturally compatible to the building design. 5. Final Approval: The final sign height, area, letter size, color and design shall be reviewed and approved by the Planning Director. 6. Landscape Plan/Tree Trimmin&: The applicant shall prepare a landscape plan to install a minimum planting of (6) 24" box evergreen trees along the railroad right-of-way to buffer the adjacent residential uses. Moderate on-site tree trimming (topping but not removing trees) would be permitted for sign visibility. 7. Sign Approval: Sign Approval is valid only for the current tenant Fry's Electronics and is not transferrable unless city council approval is granted. The tenant and or primary leasehold owner is responsible for removal of the sign and support structure at the termination of tenancy. 8. Orientation: The faces of the signs would be angled as depicted in the consultant's computer models. 9. Color: The coloring on the sign would include a mushroom or sandstone background with deep or toned down red lettering (as opposed to bright red lettering). 10. Identification: The sign will be installed for identification, not advertising purposes. e e RESOLUTION NO. 2830 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING CITY COUNCIL TO CONSIDER THE APPROVAL OF A SITE AND ARCHITECTURAL PERMIT TO ALLOW A FREEWAY ORIENTED SIGN ON PROPERTY LOCATED AT 600 EAST HAMIL TON A VENUE, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT. APPUCATION OF FRY'S ELECTRONICS, INC. FILE NO. Based upon the above findings, the Planning Commission recommends that the City Council approve the application subject to the following Conditions of Approval: 1. Approved Project: Approval is granted to construct a freeway oriented sign which shall not exceed a height of 45 feet above adjacent grade or more than 240 square feet in sign area, or a letter height of 4 feet for the lower case letters in the word "Fry's", 8.5 feet for the "F" in "Fry's" and 1.5 feet for the word "Electronics", as illustrated on the sign elevation drawing. The sign location shall be substantially as shown on the site plan labelled sheet A-1, dated August 17, 1992. 2. Permits: Applicant shall obtain any necessary electrical or building permits. 3. Sign Illumination: Approval is granted to illuminate the sign letters only. The background area shall not be illuminated. The intensity of the sign illumination shall be specified and approved by the Councilor Site and Architectural Committee prior to installation. The sign letters shall not blink or otherwise be animated. 4. Sign Design: The sign design is not approved. Final Approval: The final sign height, area, letter size and design shall be reviewed and approved by the City Councilor referred to the Site and Architectural Committee for approval. 6. Landscape Plan: The applicant shall prepare a landscape plan to plant the understory of the sign to be approved by the Councilor the Site and Architectural Committee prior to installation. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances for the City of Campbell and the State of California which pertain to this development and are not herein specified.
