RESOLUTION NO. 8296
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL APPROVING A REORGANIZATION OF CERTAIN REAL
PROPERTY PURSUANT TO THE CORTESE-KNOX LOCAL GOVERNMENT
REORGANIZATION ACT OF 1985, DESIGNATED AS LOS RANCHITOS
92-1.
After notification and a Public Hearing as specified by law for approval of a
reorganization to the allow the annexation of property located at 271 North
San Tomas Aquino Road, APN 307-18-051, and 295 North San Tomas Aquino
Road, APN 307-18-050, and, after presentation by the City Staff, proponents
and opponents, the hearing was closed.
After due consideration of all the evidence presented the City Council did
find as follows with respect to Los Ranchitos 92-1.
1. The proceedings for reorganization described in said Resolution are
designated as Los Ranchitos 92-1.
2. The subject properties are contiguous to existing City limits, and is
uninhabited as defined by LAFCO.
3. The City will request that the Local Agency Formation Commission
expand the Campbell's Sphere of Influence and Urban Service Area
Boundary to include the subject parcels. The territory is presently
located in the City of San Jose.
4. The proposed reorganization does not split lines of assessment or
ownership.
5. The proposed reorganization is consistent with the proposed General
Plan Amendment being processing concurrently with the proposed
reorganiza tion.
6. The proposal does not create island or areas in which it will be difficult
to provide municipal services.
7. Annexation of the subject sites creates a more logical boundary between
Campbell and San Jose and eliminates confusion about jurisdictional
boundaries in emergency situations.
8. The exterior boundaries of the territory to be annex are all that real
property situated in the County of Santa Clara, State of California,
described in Exhibit "A" and illustrated in the map, Exhibit "B", attached
hereto.
9. The territory described in said Resolution shall be reorganized to include
the following changes of organization:
a. Annexation to the City of Campbell.
b. De-annexation from the City of San Jose.
c. Expansion of the City of Campbell Sphere of Influence.
d. Expansion of the City of Campbell Urban Service Area Boundary.
10. Land improvements within the territory annexed shall be liable for the
general indebtedness of the City of Campbell existing at the time of
annexation.
11. The City of San Jose has preliminarily indicated its consent to the
proposed reorganization.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Campbell as follows:
1. Pursuant to Part 3 of the Cortese-Knox Local Government
Reorganization Act of 1985, (California Government Code Sections
56650 et. seq.) submits this proposal for Reorganization of territory
described in Exhibits "A" and "B" attached hereto;
2. The City of Campbell requests, pursuant to Part 3 of the Cortese-
Knox Local Reorganization Act of 1985, that the above described
territory be reorganized as follows:
a. Be detached from the City of San Jose;
b. Be included in the City of Campbell's Sphere of Influence;
c. Be included in the City of Campbell's Urban Service Area; and
d. Be annexed to the City of Campbell.
3. Land improvements within the territory annexed shall be liable for
the general indebtness of the City of Campbell existing at the time of
annexation.
4. The reasons for the proposed reorganizations are as follows:
a. Reorganization of the territory into the City of Campbell
creates a more logical boundary between the City of Campbell
and the City of San Jose;
b. Reorganization of the territory into the City of Campbell
eliminates confusion about jurisdictional boundaries in
emergency situations.
