CITY OF CAMPBELL, CALIFORNIA
BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL, APPROVING AN EXTENSION OF A PREVIOUSLY
APPROVED TENT A TIVE SUBDIVISION MAP ALLOWING THE
CREATION OF 32 TOWNHOMES ON PROPERTIES LOCATED AT 63-
190 PAGE STREET AND 56-70 FOOTE AVENUE, IN A PD (PLANNED
DEVELOPMENT fLOW-MEDIUM DENSITY RESIDENTIAL) ZONING
DISTRICT. FILE NO. R 92-02 (1'5 90-04), LANDS OF DOWD APN: 279-
43-001,002,003,004,012,013,014
After notification and public hearing as specified by law on the application for
approval of a Tentative Subdivision Map as referenced in the above heading;
as per the application filed in the Planning Department on January 31, 1992;
and, after presentation by the Planning Director, proponents and opponents,
the hearing was closed.
After due consideration of all evidence presented, the City Council did find as
follows, with respect to File No. R 92-02 (TS 90-04):
1. There have been no changes in the General Plan or Zoning since
the previous approval.
2. Approval of the extension will coincide with the Planned
Development Permit expiration date, and
3. No modifications to the previous approval are requested by the
applicant.
Based upon the foregoing findings of fact, the City Council further finds and
concludes that:
1. The proposed subdivision is consistent with the General Plan.
2. The proposed subdivision improves the balance between the
housing needs of the region and the service needs of its
residents.
3. That the site is physically suitable for the proposed density and
type of development.
Based upon the above-findings, the City Council does hereby approve this
map, subject to the Conditions of Approval attached hereto, as Exhibit A.

CONDITIONS OF APPROVAL FOR FILE NO. R 92-02 (TS 90-04)

The applicant is notified, as part of this application, that he is required to
comply with all applicable Codes and/or Ordinances of the City of Campbell
and the State of California which pertain to this development and are not
herein specified.
1. Sewers: Installation of a sanitary sewerage system to serve all lots
within the subdivision in conformance with the proposed plans of the
County of Santa Clara Sanitation District No.4. Sanitary sewerage
service to be provided by said District No.4.
2. Water Service: Installation of a water distribution system to serve all
lots within the subdivision in conformance with the plans of the San
Jose Water Company. Water service to be provided by said water
company. Fire hydrants and appurtenances shall be provided by
applicant and installed at the locations specified by the Fire Chief, Fire
Department, City of Campbell. Fire hydrant installation permit shall be
obtained from the Fire Department prior to installation of fire
hydrants.
3. Subdivision Map Act: Compliance with the provisions of Title 20,
Subdivisions of the Campbell Municipal Code.
4. Storm Drain Fee: Subdivider to pay Storm Drainage Area Fee of
$2060/ acre.
5. Surety: Subdivider shall install street improvements and post surety to
guarantee the work.
6. Dedications: Dedicate additional right-of-way to widen Page Street and
Foote Avenue to 30 feet from centerline. Dedication on Foote Avenue
to extend northerly to the SPRR property line.

7. Code, Covenants & Restrictions: CC&R's to be approved by the City
Engineer to ensure provisions for maintenance of buildings and
common area.
8. Grading/Drainage Plan: Provide a grading and drainage plan for the
review and approval of the City Engineer.
9. Encroachment Permit: Obtain an encroachment permit and pay fees
and deposit for all work in the public right-of-way.
10. Park Lands Dedication: Pay a fee of $86,944 in lieu of dedication of land
for parks.
11. Easement: Provide evidence that six (6) separate easements currently
encumbering property have been abandoned.
12. Map Expiration: This tentative subdivision map is valid until January
16, 1993.
