BEING A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF
AMENDMENTS TO THE CONDITIONS OF APPROVAL FOR A
PREVIOUSLY-APPROVED USE PERMIT (UP 92-01), FOR PROPERTY
LOCATED AT 220 E. CAMPBELL AVENUE IN A C-3-S (CENTRAL
BUSINESS DISTRICT) ZONING DISTRICT. APPLICATION OF MR
ROBERT RAFFANTI, JR. FILE NO. UP 92-01.
After notification and Public Hearing as specified by law on the application of
the Mr. Robert Raffanti, Jr. to amend the previously-approved Conditions of
Approval for a Conditional Use Permit allowing office use at a property
located at 220 E. Campbell Avenue and after presentation by the Planning
Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. UP 92-01:
Allowing additional time for the installation of the awning treatment
until December 31, 1994, provides a reasonable compliance date and
insures the architectural merits of this project.
o
The required landscaping improvements will enhance the appearance of
this project and help integrate this use into the downtown area.
o
Adequate provision has been made to insure proper ingress/egress from
this site.
Based upon the foregoing findings of fact, the Planning Commission
concludes that:
The establishment, maintenance, or operation of the use applied for will
not be detrimental to the public health, safety, peace, morals, comfort or
general welfare of persons residing or working in the neighborhood of
such proposed use, or be detrimental or injurious to property and
improvements in the neighborhood or to the general welfare of the City.
o
The proposed site is adequate in size and shape to accommodate the said
use with uses in the surrounding area.
o
The proposed site is adequately served by streets of sufficient capacity to
carry the kind and quantity of traffic such use would generate.
4. The proposed use is compatible with the uses in the area.

Further, the applicant is notified as part of this application that he/she is
required to meet the following conditions in accordance with the Ordinances
of the City of Campbell and the State of California. The lead department with
which the applicant will work is identified on each condition. Additionally,
the applicant is hereby notified that he/she is required to comply with all
applicable Codes or Ordinances of the City of Campbell and the State of
California that pertain to this development and are not herein specified.
Amended Conditions of Approval (New language is highlighted):
Elevations: Elevations indicating a revised awning design incorporated a varied shape
and more subdued color to be submitted to the Planning Department and approved by
the Planning Director upon recommendation of the Architectural Advisor prior to
application for a building permit. The awnings shall utilize a fade resistant material
subject to approval of the Planning Commission and be installed by December
31, 1994. (Planning)
Landscaping: Landscaping plan indicating type and size of plant material, and located
irrigation system to be submiued to the Planning Department and approved by the Site
and Architectural Review Committee prior to issuance of a building permit.
Landscape plans to address landscaping along East Campbell Avenue frontage and
the parking area and to be installed by April 1, 1994. (Planning)

Alleyway: In accordance with the parking layout shown on the
approved site plan, applicant shall exit the parking area through the
alleyway at the south end of this property. If applicant's
ingress/egress access through the alleyway is precluded, applicant
shall immediately terminate the use granted under this Use Permit.
Applicant may then appeal to the Community Development Department
for a modification to this Use Permit to reflect the loss of the
ingress/egress through the alleyway. Additionally, applicant shall
maintain alleyway in a manner which will provide for safe passage for
vehicles, bicycles and pedestrians.
