RESOLUTION NO. 8213 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING A REINSTATEMENT OF A PREVIOUSLY PLANNED DEVELOPMENT PERMIT, PLANS, ELEVATIONS, DEVELOPMENT SCHEDULE, AND CONDmONS OF APPROVAL TO ALLOW TWO SINGLE- FAMILY HOMES, ON PROPERTY LOCATED AT 176 EAST RINCON AVENUE, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT, APPLICATION OF MR. JOE PUCCI, FILE NO. R 91-06 ( PD 90-05). After notification and Public Hearing as specified by law on the application of Mr. Joe Pucci, for approval of a Reinstatement to a previously approved Planned Development Permit, plans, elevations, and development schedule to allow two single-family homes, on property located at 176 East Rincon A venue, in a PD (Planned Development) Zoning District; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows with regard to File No. R 91-06: 1. The General Plan allows a density range of 6-13 dwelling units per acre on the subject site. 2. The proposal will result in a density of 9.5 dwelling units per acre. 3. The proposed parking meets the requirements of the Parking Ordinance. 4. The conditions of approval require an agreement for the joint maintenance of access areas. ~ Based on the foregoing findings of fact, the City Council further finds and concludes that: 1. The proposed development would clearly result in a more desirable environment and use of land than would be possible under any other zoning classification. 2. The proposed development would be compatible with the General Plan of the City, and will aid in the harmonious development of the immediate area. . The proposed development will not result in allowing more residential units than would be allowed by other residential zoning districts which are consistent with the General Plan designation of the property. 4. The proposed development would not be detrimental to the health, safety, or welfare of the neighborhood or of the City as a whole. 5. The proposed additional living unit is compatible with the surrounding neighborhood. 6. The project is consistent with the Development Polices for downtown residential neighborhoods contained in Ordinance No. 1797. Based upon the above findings, the City Council approves the Reinstatement by adopting the attached Exhibit A, entitled Plans and Elevations; Exhibit B, entitled Development Schedule; Exhibit C, entitled Conditions of Approval, as per the application of Mr. Joe Pucci, for plans, elevations, and development schedule to allow a one-year extension of the previously approved Planned Development Permit, in a Planned Development Zoning District. Copies of Said Exhibits are on file in the Planning Department. This approval is for a) reinstatement of a Planned Development to allow the construction of a second dwelling and b) a parcel map to create two lots totaling 2,800 square feet and 4,500 square feet respectively on a 7,300 square foot site identified as Assessor's Parcel Number 412-06-066. Development shall be substantially as shown on the project materials listed below, except as may be modified by conditions contained herein: (Planning) a. Project drawings for Mr. Joe Pucci prepared by Peter Sano consisting of 11 sheets dated November 1, 1991. b. Tentative Parcel Map for Mr. Joe Pucci prepared by Melvin Hill consisting of 1 sheet dated August 8, 1991. LANDSCAPING 2. The applicant shall submit a revised landscaping plan indicating type and size of plant material, and location of irrigation system, to be submitted to the Planning Department and approved by the Planning Director prior to application for a building permit. 3. The existing five foot diameter Pepper tree located in the rear portion of the site shall be retained. A detailed plan incorporating said procedures shall be submitted to the Planning Department and approved by the Planning Director prior to the issuance of building permits. PROPERTY MANAGEMENT fUTILITIES 4. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and construction establishments. (Planning) 6. The applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. (Planning) PUBLIC SAFETY/WELFARE 7. Pay a fee in lieu of dedicating lands for parks. (Public Works) 8. Dedicate an additional five feet from centerline for street right-of-way creating a total of 30' from centerline. (Public Works) 9. Pay storm drain area fee of $305. 10. Pay a pro-rata share of new traffic signal at Rincon Avenue and Winchester Boulevard in the amount of $875. 11. Calculations by a registered Engineer required for two-story residences. Plans to bear Engineer's stamp and signature. UBC code 302(a). (Building) 12. Two-story structure requires a minimum of 8" foundation wall, 15" wide footing and a 7' thick footing. UBC code T29-A. (Building) 13. Street access to house must be maintained for both fire fighting and medical responses. (Fire) 14. Street access must be dearly visible from the street. (Fire) 15. Rear parcel must have an on-site hydrant or a 13 D sprinkler system.
