PC Res 2904RESOLUTION NO. 2904 BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CAMPBELL RECOMMENDING APPROVAL OF A CONDITIONAL USE PERMIT ALLOWING A RETAIL PET STORE ON PROPERTY LOCATED AT 90 N. SAN TOMAS AQUINO ROAD IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT. APPLICATION OF MS. BRENDA ALBRECHT ON BEHALF OF DOLPHIN PET VILLAGE. FILE NO. UP 93-18. After notification and Public Hearing as specified by law on the application of the Ms. Brenda Albrecht, on behalf of Dolphin Pet Village, to allow a retail pet store on property located at 90 N. San Tomas Aquino Road, as per the application filed in the Planning Department on January 5, 1994; and, after presentation by the Planning Director, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the Planning Commission did find as follows with respect to File No. UP 93-18: The proposed retail pet store use is compatible with the existing uses in the shopping center and with the uses in the general vicinity. The proposed retail pet store does not represent an intensification of usage in than that of the previous occupant, a fitness spa. The provision of a shared parking facility at a ration of 1:235 for this shopping center adequately addresses the parking demand for this use. The parking area, with the introduction of tree wells as red-lined, adequately addresses the landscaping standards of the zoning ordinance and the needs to buffer adjacent residential uses. Based upon the foregoing findings of fact, the Planning Commission concludes that: The establishment, maintenance, or operation of the use applied for will not be detrimental to the public health, safety, peace, morals, comfort or general welfare of persons residing or working in the neighborhood of such proposed use, or be detrimental or injurious to property and improvements in the neighborhood or to the general welfare of the City. The proposed site is adequate in size and shape to accommodate the said use with uses in the surrounding area. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate. T' r Resolution No. 2904 LIP 93-18 -- 90 N. Further, the applicant is notified as part of this application that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with which the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. Approved Use: Approval is granted for a retail pet store of 9,600 square feet. The retail pet store shall conform to applicant's description dated December 27, 1993. Hours of Operation: Hours of operation are permitted as follows: Monday through Friday 10 a.m. until 9 p.m. Saturday and Sunday 10 a.m. until 6 p.m. Landscaping: Landscaping plan indicating eight (8) 15-gallon canopy-type trees in existing landscape areas be submitted to the Planning Department and approved by the Community Development Director upon recommend- ation of the Landscape Advisor, prior to issuance of building permit for tenant improvements. (Planning) o Landscape/Fence: Landscaping and fendng to be maintained in accord- ance with the approved plans. (Planning) o Trash Enclosure: Applicant to submit a plan for a trash enclosure. The enclosure shall consist of a concrete floor surrounded by a solid wall or fence and have a size specified by the Community Development Director and have a level area adjacent to the trash enclosure area to service the container. (Planning) Applicant to secure any necessary permits from the County of Santa Clara and State of California jurisdiction which regulates the sale of pets. Resolution No. 2904 UP 93-18 -- 90 N.
