CC Resolution 8135RESOLUTION NO. sis5 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL, RECOMMENDING APPROVAL OF A FINAL SUBDIVISION MAP, FILE NO. TS 90-02, LANDS OF SARAY, APN: 279-37-039, 949, AND 041, ON PROPERTY LOCATED AT 65-85 LATIMER AVENUE. After notification and public hearing as specified by law on the application for approval of a Final Subdivision Map as referenced in the above heading; as per the application filed in the Planning Department on Januazy 10, 1990; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows, with respect to File No. TS 90-02: 1. The proposed density of 11.4 units per gross acre indicated on the Final Map is consistent with the General Plan. 2. The proposed subdivision does not upset the balance between the housing needs of the region and public service needs of its residents. 3. The proposed map is consistent with the previously approved Planned Development Permit and the plan approved for the property. Based upon the foregoing findings of fact, the City Council further finds and concludes that, subject to the imposed conditions: 1. The imposed subdivision is consistent with the General Plan; 2. The proposed subdivision does not impair the balance between the housing needs of the region and the public service needs of its residents and available fiscal and environmental resources; 3. The design of the subdivision provides, to the extent feasible, for future passive or natural heating or cooling opportunities. Based upon the above-findings, the City Council does hereby recommend approval of this map to the City Council, subject to the Conditions of Approval attached hereto, as Exhibit A. Kotowski, Mayor ATTEST: Barbara Olsasky, EXHIBIT A CONDITIONS OF APPROVAL FOR TS 90-02 65-85 EAST LATIMER AVENUE The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with which at the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. 1. Grading and Drainage Plans: Provide grading and drainage plans for review by the City Engineer. (Public Works) 2. Park Dedication Fee: Applicant to pay Park Dedication In-lieu Fee of $2,835, in addition to those already paid. (Public Works) 3. Public Utility Easement: Correct site plan to show retention of existing separated walk along the Latimer frontage. Plant street trees within parkway strip as directed by City Engineer. 4. Provide 5 foot public utility easement behind existing back of walk on both the Ester and Latimer frontages. 5. Obtain an encroachment permit, pay fees and post surety to relocate driveways, install handicapped ramp, install street light and other work within the public right-of-way. 6. Process and file a subdivision map creating the lots.
