CC Resolution 8134RESOLUTION NO. $134 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING THE REINSTATEMENT OF A PREVIOUSLY APPROVED PLANNED DEVELOPMENT PERMTT, PLANS, ELEVATIONS, DEVELOPMENT SCHEDULE, AND CONDITIONS OF APPROVAL TO ALLOW CONSTRUCTION OF NINE TOWNHOMES, ON PROPERTY LOCATED AT 65-85 LATIMER AVENUE, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT, APPLICATION OF MR. STEVE SARAY, FILE NO.91-05 (PD 89-16). After notification and Public Hearing as specified by law on the application of Mr. Steve Saray, for approval of a Planned Development Permit, plans, elevations, and development schedule to allow construction of nine townhomes, on property located at 65-85 Latimer Avenue, in a PD (Planned Development) Zoning District; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows with regard to File No. R 91-05 (PD 89-16): 1. The project is developed at 11.4 units per gross acre, consistent with the General Plan designation of 6-13 units per gross acre. 2. The building designs are compatible to the surrounding neighborhood. 3. Approval of the reinstatement will allow the applicant to expeditiously begin construction of the project. 4. Substantial landscaping for the proposed project will contribute in the enhancement of the neighborhood. Based upon the foregoing findings of fact, the City Council further finds and concludes that 1. The proposed development and uses clearly would result in a more desirable environment and use of land than would be possible under any other zoning classification; and, 2. The development and uses would be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. Resolution No. sis4 adopted July 2,1991 page two 3. The proposed development would not be detrimental to the health, safety or welfare of the neighborhood or the City as a whole. 4. The proposed site is adequately served by streets of sufficient capacity to carry the kind and quantity of traffic such use would generate; and Based upon the above findings, the City Council approves the Permit by adopting the attached Exhibit A, entitled Plans and Elevations; Exhibit B,m entitled Development Schedule; Exhibit C, entitled Conditions of Approval, as per the application of Mr. Steve Saray, for plans, elevations, and development schedule to allow construction of 9 townhomes, in a Planned Development Zoning District. Copies of Said Exhibits are on file in the Planning Department. R 91-05 APPLICANT: Steve Saray SITE ADDRESS: 65-85 Latimer Avenue P.C. MEETING DATE: July 2,1991 1. Construction to begin within one year of final approval. 2. Construction to be complete within one year of starting date. EXHIBIT C CONDITIONS OF APPROVAL SITE ADDRESS: 65-85 LATIMER AVENUE APPLICANT: STEVE SARAY The applicant is hereby notified, as part of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. The lead department with which at the applicant will work is identified on each condition. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell and the State of California that pertain to this development and are not herein specified. SITE AND BUILDING DESIGN 1. Building OccupancX: Building occupancy will not be allowed until public improvements are installed. (Public Works) 2. Approved Project: The approval is for reinstatement of the Planned Development Permit located on 65-85 East Latimer Avenue, APN: 379-37-039, 40, 41. Approved plans include those demonstrated in the exhibits prepared by Nadcon Development, Inc., sheets A-1 through A-9. LANDSCAPING 3. Landscaping: Landscaping for the proposed development will be subject to the landscaping plan submitted in 4-12-90 and prepared by Greg G. Ing and Associates. STREET/SITE IMPROVEMENTS 4. Parking and Driveway: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal code. All parking spaces to be provided with appropriate concrete curbs or bumper guards. (Planning) 5. Fences: Fencing plan indicating location and design details of fencing to be submitted to the Planning Department and approved by the Planning Director prior to issuance of a building permit. (Planning) PROPERTY MANAGEMENT/UTILITIES 6. Property Maintenance: The property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed CONDITIONS OF APPROVAL FOR R 91-05 PAGE NO.2 - EXHIBTT C shut, or be demolished or removed from the property (Section 11.201 & 11.414, 1985 Ed. Uniform Fire Code). (Fire) 7. Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage and rubbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple family dwellings, and all commercial, business, industrial, manufacturing, and construction establishments. (Fire) 8. Trash Containers: Trash container(s) of a size and quality necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these containers. (Fire) PUBLIC SAFETY/WELFARE 9. Handicapped Requirements: Applicant City requirements for the handicapped. shall comply with all appropriate State and (Building) 10. Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) 11. Utility Boxes and Back-Flow Preventers: Applicant to submit a plan to the Planning Department, prior to installation of PG&E utility (transformer) boxes and S.J. Water back-flow preventers, indicating the location of the boxes and screening (if boxes are above ground) for approval of the Planning Director. (Planning) 12. Eauiyment Screening: All mechanical equipment on roofs and all utility meters to be screened for approval by the Planning Director. (Planning) 13. Utility Connections: Plans submitted to the Building Division for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. (Building) 14. Noise Levels: Noise levels for the interior of residential units shall comply CONDITIONS OF APPROVAL FOR R 91-05 PAGE 3 - EXHIBTT C with minimum State (Title 24) and local standards as indicated in the Noise element of the Campbell General Plan. (Building) 15. Grading and Drainage Plans: Provide grading and drainage plans for review by the City Engineer. (Public Works) 16. Park Dedication Fee: Applicant to pay Park Dedication In-lieu Fee of $2,835, in addition to those already paid. (Public Works) 17. Performance Bond: Applicant to either (1) post a faithful performance bond in the amount of $5,000 to ensure landscaping, fencing, and striping of parking areas within 3 months of completion of construction; or (2) file a written agreement to complete landscaping, fencing and striping of parking areas. Bond or agreement to be filed prior to application for a building permit. (Planning) 18. Public Utility Easement: Correct site plan to show retention of existing separated walk along the Latimer frontage. Plant street trees within parkway strip as directed by City Engineer. 19. Provide 5 foot public utility easement behind existing back of walk on both the Ester and Latimer frontages. 20. Obtain an encroachment permit, pay fees and post surety to relocate driveways, install handicapped ramp, install street light and other work within the public right- of-way. 21. Process and file a subdivision map creating the lots.
