BEING A RESOLUTION OF THE CTTY COUNCIL OF THE CITY OF
CAMPBELL RATIFYING PLANNING COMMISSION APPROVAL
OF THE DOWNTOWN DEVELOPMENT PERMIT, TO ALLOW
ESTABLISHMENT OF ADMINISTRATIVE OFFICES ON
PROPERTY LOCATED AT 200 EAST CAMPBELL AVENUE,
IN A C-3-S (CENTRAL BUSINESS) ZONING DISTRICT;
APPLICATION OF TINY TOTS, NO. DDP 91-02.
After notification and Public Hearing as specified by law on the application of
Tiny Tots, for approval of a Downtown Development Permit to allow
establishment of Administrative Offices, located at 200 East Campbell Avenue, in a
C-3- S (Central Business) Zoning District, as per the application filed in the Planning
Department on May 13, 1991 and, after presentation by the Planning Director,
proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the City Council does find
as follows with respect to File No. DDP 91-02.
1. The proposal consists of using an existing building at 200 East Campbell
Avenue as an administrative office;
2. The building had been previously used as a bank;
3. The building has been vacant for some time, and has become unkept;
4. The building is located on a 342,750 net square foot lot;
5. The building has a gross floor area of 7,550 square feet;
6. The lot provides 52 parking spaces;
7. The landscaping has been allowed to deteriorate;
8. Drive-up windows and night depositories are still visible, and the Automated
Teller has been boarded up.
Based upon the foregoing findings the City Council further finds and
concludes that this proposed project, as conditioned would:

2. Ensure the availability of adequate parking for retail and service commercial
customers;
3. Establish development intensities consistent with the scale of the downtown
area and the amount of parking which can be accommodated within the area
adjacent to it; and,
4. Maintain the comfortable scale, character and diversity of a small town
business district.
Based upon the above findings, the City Council does hereby ratify the
Planning Commission action approving the Downtown Development Permit,
subject to the following Conditions of Approval:
SITE AND BUILDING DESIGN
1. Repair of the Building and Landscaping:
The applicant shall submit revised elevations and a site plan to the Planning
Department for review and approval prior to issuance of a building permit.
Plans shall indicate the following revisions:
a. Repair of the former ATM housing that is currently boarded-up.
b. Remove the discoloration on the building exterior.
2. Ayyroved Project:
This approval is for administrative offices located on a .75 acre site identified
as Assessor's Parcel Number 412-06-007, 008, and 009. Development shall be
substantially as described in the applicant's letter, received May 16, 1991,
except as modified by conditions contained herein. The use of the site for the
warehousing of diapers or other products not related to administrative office
use is prohibited.
3.
The applicant shall sign a binding agreement with the City, in a form
acceptable to the City Attorney, embodying the conditions of this
Downtown Development Permit. Said Downtown Development Permit
shall not be deemed effective until said agreement has been executed and
notarized.
4. Project Review:
Project plans shall comply to all applicable code requirements and a formal
plan review. (Building)

LANDSCAPING
5. Landscaping:
Landscaping plan indicating type and size of plant material, and location of
irrigation system to be submitted the Planning Department and approved by
the Planning Director prior to issuance of a building permit. The intent of
this condition is to upgrade existing landscaping. (Planning)
6. Landscaping Maintenance Requirements:
All landscaped areas shall be continuously maintained. Landscape areas shall
be watered on a regular basis so as to maintain healthy plants. Landscaped
areas shall be kept free of weeds, trash and litter. Any plants which die shall
be replaced with healthy plants of the same or similarly type. (Planning)
STREET/SITE IMPROVEMENTS
7. On-site Parking:
On-site parking is limited to passenger vehicles. Passenger vehicles shall be
defined as a vehicle designed for carrying no more than 10 persons, including
the driver, and used solely for the transportation of persons. The on-site
parking of non-passenger vehicles is limited to loading and unloading
purposes only, during, authorized business hours.
8. Signs:
Sign application to be submitted in accordance with provisions of the C-3
Ordinance and the Sign Ordinance. No sign to be installed until application
is approved and the permit issued by the Planning and Building Departments
(Section 21.53 of the Campbell Municipal Code). (Planning)
PROPERTY MANAGEMENT/UTILITIES
9. Trash Enclosures:
The applicant shall demonstrate that the existing trash enclosures complies
with the Fire Department requirements. Should the enclosure no comply
with Fire Department requirements, the applicant shall construct a new
enclosure or modify the existing enclosure to comply with Fire Department
standards. (Fire)
10. Handicapped Requirements:
Applicant shall comply with all appropriate State and City requirements for
the handicapped. Handicapped accessibility is required to all first floor
bathroom facilities. (Building)

11. Building OccupancX:
In lieu of completing all required work prior to building occupancy, the
applicant shall submit a cash deposit in the amount for the improvements
required to comply with conditions contained herein. The applicant shall
submit cost estimates for all required work. The deposit shall be refunded
after work has been completed and accepted by the Planning Director. All
work shall be completed within 60 days of submission of deposit.
12. Review of Downtown Development Permit:
The Planning Commission and/or City Council may review this Downtown
Development Permit at any time. The permit may be revoked should the
Planning Commission and/or City Council hold a public hearing and
determine that the applicant is not complying with the Conditions of
Approval.
13. Site Distance:
Remedy the inadequate site distance at the Corner of Orchard City Drive and
Second Street by removal and replacement of landscaping that the southern
end of the property to maximum height of 3 feet above the top of the curb.
14. Mechanical Equipment Screening:
All mechanical equipment screening located on the roof shall be screened and
approved by the Planning Director.
Further, the applicant is notified as part of this application that he is required to
comply with all applicable Codes and Ordinance of the City of Campbell and the
State of California which pertain to this development and are not herein specified.
