CC Resolution 8132RESOLUTION NO. 8132 BEING A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAMPBELL APPROVING THE REINSTATEMENT OF PREVIOUSLY APPROVED PLANNED DEVELOPMENT PERMIT, PLANS, ELEVATIONS, DEVELOPMENT SCHEDULE, AND CONDITIONS OF APPROVAL TO ALLOW CONSTRUCTION OF THIZEE TOWNHOMES, ON PROPERTY LOCATED AT 548 WEST HACIENDA AVENUE, IN A PD (PLANNED DEVELOPMENT) ZONING DISTRICT, APPLICATION OF MR RUSS ALESHI, FILE NO. R 91-03 (PD 89-15). After notification and Public Hearing as specified by law on the application of Mr. Russ Aleshi, for approval of a Reinstatement of a previously approved Planned Development Permit, plans, elevations, and revised development schedule to allow construction of three townhomes, on property located at 548 West Hacienda Avenue, in a PD (Planned Development) Zoning District; and, after presentation by the City Staff, proponents and opponents, the hearing was closed. After due consideration of all evidence presented, the City Council did find as follows with regard to File No. R 91-03: 1. There have been no changes in the General Plan for this area since the City Council's approval. 2. The project remains consistent with the General Plan designation of Low/Medium Density Residential. 3. Approval of Planned Development Permit is valid one year from the date of approval. Based upon the foregoing findings of fact, the City Council further finds and concludes that 1. The proposed development and uses clearly would result in a more desirable environment and use of land than would be possible under any other zoning classification; and 2. The development and uses would be compatible with the General Plan of the City and will aid in the harmonious development of the immediate area. 3. The proposed development would not result in allowing more residential units than would be allowed by other residential zoning districts which are consistent with the general plan designation of the property; and, 4. The proposed development would not be detrimental to the health, safety or welfare of the neighborhood or the City as a whole. Based upon the above findings, the City Council approves the Reinstatement by adopting the attached Exhibit A, entitled Plans and Elevations; Exhibit B, entitled Revised Development Schedule; Exhibit C, entitled Conditions of Approval, as per the application of Mr. Russ Aleshi, for plans, elevations, and revised development schedule to allow construction of three townhomes, in a Planned Development Zoning District. Copies of Said Exhibits aze on file in the Planning Department. MEETING DATE: June 11,1991 The applicant is hereby notified, as pazt of this application, that he/she is required to meet the following conditions in accordance with the Ordinances of the City of Campbell and the State of California. Additionally, the applicant is hereby notified that he/she is required to comply with all applicable Codes or Ordinances of the City of Campbell land the State of California which pertain to this development and are not herein specified. SITE AND BUILDING DESIGN i. Revised elevations and/or site plan indicating stepping of building mass and elimination of wainscoat to be submitted to the Planning Department and approved by the Planning Director upon recommendation of the Architectural Advisor prior to application for a building permit. (Planning) 2. Public OccupancX: Building occupancy will not be allowed until public improvements are installed. (Public Works) 3. Anvroved Proaect: This approval is for a reinstatement of a Planned Development Permit located on a 8,462 squaze foot site identified as Assessor's Parcel Number 406-20-007. Development shall be substantially as shown on the project materials listed below, expect as may be modified by conditions contained herein: a. Project drawings for 548 W. Hacienda prepared by Andazch Associates consisting of elevations, site plan, floor plans, sections and details, roof plan and foundation plan (25 pages), dated 12/20/89. b. Perspective Drawing. LANDSCAPING 4. Landscaping: Landscaping plan indicating type and size of plant material, and location of irrigation system to be submitted to the Planning Depaztment and approved by the Site and Architectural Review Committee and/ or Planning Commission prior to issuance of a building permit. (Planning) 5. Landscaping Revision: The landscape plan dated 1/8/90 shall be modified to comply with the City's Water Efficient Landscape Standazds (WELS). A WELS checklist shall be submitted with the final Conditions of Approval: R 9]-03 June 11,1991 landscape plan for review and approval of the Planning Department. (Planning) STREET/SITE IMPROVEMENTS 6. Parking and Driveways: All parking and driveway areas to be developed in compliance with Chapter 21.50 of the Campbell Municipal code. All parking spaces to be provided with appropriate concrete curbs or bumper guazds. (Planning) 7. Fences: Fencing plan indicating location and design details of fencing to be submitted to the Planning Department and approved by the Planning Duector prior to issuance of a building permit. (Planning) 8. Signs: Sign application to be submitted in accordance with provisions of the Sign Ordinance for all signs. no sign to be installed until application is approved and permit issued by Planning and Building Departments (Section 21.53 of the Campbell Municipal Code). (Planning) 9. Right-of Way Dedication: Dedicate additional right-of -way to widen Hacienda Avenue to 45 feet from center. (Public Works) 10. Street Improvements: Install standard street improvements in Hacienda Avenue and Walnut Drive including electroliers. (Public Works) il. Encroachment Permit: Obtain an encroachment permit, pay fees, and post surety for all work in the public right-of-way. (Public Works) 12. Storm Drain Fee: Pay storm drain azea fee. (Public Works) 13. Plans: Provide 5 sets of grading and drainage plans. (Public Works) 14. Parcel Man: Process and file a pazcel map. (Public Works) PROPERTY MANAGEMENT/UTILITIES 15. Proper Maintenance: T'he applicant is hereby notified that the property is to be maintained free of any combustible trash, debris and weeds, until the time that actual construction commences. All existing structures shall be secured by having windows boarded up and doors sealed shut, or be demolished or removed from the property. Section 11.201 & 11.414, 1985 Ed. Uniform Fire Code. (Fire Department) 16. Retaining Walls: Retaining walls at property lines aze limited to a height of 15 inches if constructed of wood. (Building) Conditions of Approval: R 91-03 3 June 11,1991 17. Garbage Collection: Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet gazbage and nebbish produced within the limits of the City of Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single-family dwellings, multiple apartment units, to all commercial, business, industrial, manufacturing, and rnnstruction establishments. (Fire Department) 18. Trash Containers: Trash mntainer(s) of a size and quality necessary to serve the development shall be located in azea(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall mnsist of a concrete floor surrounded by a solid wall or fence and have self-closing doors of a size specified by the Fire Department. All enclosures to be constructed at grade level and have a level area adjacent to the trash enclosure area to service these rnntainers. (Fire Department) PUBLIC SAFETY/WELFARE 19. HandicaQped Requirements: Applicant shall comply with all appropriate State and City requirements for the handicapped. (Building) 20. Underground Utilities: Underground utilities to be provided as required by Section 20.36.150 of the Campbell Municipal Code. (Public Works) 21. Utility Boxes: Applicant to submit a plan to the Planning Department, prior to installation of PG&E utility (transformer) boxes, indicating the location of the boxes and screening (if boxes aze above ground) for approval of the Planning Duector. (Planning) 22. Equipment Screening: All mechanical equipment on roofs and all utility meters to be screened as approved by the Planning Director. (Planning) 23. Utility Connections: Plans submitted to the Building Division for plan check shall indicate clearly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. (Building) 24. Noise Levels: Noise levels for the interior of residential units shall comply with minimum State (Title 25) and local standazds as indicated in the Noise element of the Campbell General Plan. (Building) 25. Performance Bond: Applicant to either (1) post a faithful performance bond in the amount of $ 10,000 to ensure landscaping, fencing, and striping of pazking areas within 3 months of completion of Conditions of Approval: R 91-03 June 11,1991 construction; or (2) file a written agreement to complete landscaping, fencing and striping of pazking azeas. Bond or agreement to be filed with the Planning Department prior to application for a building permit. (Planning) 26. Pazk Dedication Fee: Applicant is hereby notified that he will be required to pay Pazk Dedication In-lieu Fee which will be assessed at the time the tentative parcel map is submitted.
